1.1 A bill for an act 1.2 relating to the environment; extending the 1.3 notification requirements for landfarming contaminated 1.4 soil to unorganized townships; requiring that notice 1.5 must be filed with the county recorder when a permit 1.6 is issued to landfarm contaminated soil; amending 1.7 Minnesota Statutes 1994, section 116.07, subdivision 1.8 11. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Minnesota Statutes 1994, section 116.07, 1.11 subdivision 11, is amended to read: 1.12 Subd. 11. [PERMITS; LANDFARMING CONTAMINATED SOIL.] (a) If 1.13 the agency receives an application for a permit to spread soil 1.14 contaminated by a harmful substance as defined in section 1.15 115B.25, subdivision 7a, on land in
aan organized or 1.16 unorganized township other than the township of origin of the 1.17 soil, the agency must notify the board of the organized 1.18 township, or the county board of the unorganized township, where 1.19 the spreading would occur at least 60 days prior to issuing the 1.20 permit. 1.21 (b) The agency must not issue a permit to spread 1.22 contaminated soil on land outside the township of origin if, by 1.23 resolution, the township board of the organized township, or the 1.24 county board of the unorganized township, where the soil is to 1.25 be spread requests that the agency not issue a permit. 1.26 (c) If the agency issues a permit to spread contaminated 1.27 soil on land, the owner of the land must file a notice with the 2.1 county recorder of the county where the land is located.
