  1.1                          A bill for an act
  1.2             relating to alcoholic beverages; extending dram shop 
  1.3             liability to include illegal providing or furnishing 
  1.4             of alcoholic beverages to persons under age 21 by 
  1.5             persons age 21 or more; amending Minnesota Statutes 
  1.6             1994, section 340A.801, subdivision 1; repealing 
  1.7             Minnesota Statutes 1994, section 340A.801, subdivision 
  1.8             6. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 340A.801, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [RIGHT OF ACTION.] A spouse, child, parent, 
  1.13  guardian, employer, or other person injured in person, property, 
  1.14  or means of support, or who incurs other pecuniary loss by an 
  1.15  intoxicated person or by the intoxication of another person, has 
  1.16  a right of action in the person's own name for all damages 
  1.17  sustained against a person who caused the intoxication of that 
  1.18  person by illegally (1) selling alcoholic beverages, or (2) 
  1.19  where the person committing the illegal act is age 21 or older, 
  1.20  providing or furnishing alcoholic beverages to a person under 
  1.21  age 21.  All damages recovered by a minor under this section 
  1.22  must be paid either to the minor or to the minor's parent, 
  1.23  guardian, or next friend as the court directs. 
  1.24     Sec. 2.  [REPEALER.] 
  1.25     Minnesota Statutes 1994, section 340A.801, subdivision 6, 
  1.26  is repealed. 
  1.27     Sec. 3.  [EFFECTIVE DATE.] 
  2.1      Sections 1 and 2 are effective August 1, 1995, and apply to 
  2.2   causes of action arising on and after that date.
