  1.1                             A resolution
  1.2             memorializing the Congressional Delegation of the 
  1.3             State of Minnesota to support the President's call for 
  1.4             legal reform. 
  1.5      
  1.6      WHEREAS, a fair and efficient legal system free from 
  1.7   frivolous and abusive litigation is necessary for a vibrant 
  1.8   economy and access to affordable healthcare; and 
  1.9      WHEREAS, reasonable caps on damages protect consumers from 
  1.10  the rising costs of and diminishing access to products and 
  1.11  services that result from lawsuit abuse; and 
  1.12     WHEREAS, victims who suffer losses, not their attorneys, 
  1.13  should receive the majority of damage awards; and 
  1.14     WHEREAS, lawsuits filed in a timely fashion promote 
  1.15  fairness for all parties; and 
  1.16     WHEREAS, in accordance with the intent of the framers of 
  1.17  the Constitution, cases involving residents of different states 
  1.18  should be tried in federal court; and 
  1.19     WHEREAS, individuals suffer the most damaging effects of 
  1.20  frivolous lawsuits as the cost of products and services rises 
  1.21  due to the exorbitant increases in insurance costs; NOW, 
  1.22  THEREFORE, 
  1.23     BE IT RESOLVED by the Legislature of the State of Minnesota 
  1.24  that it requests our elected Representatives and Senators in the 
  1.25  United States Congress to support meaningful class action reform 
  2.1   and medical malpractice liability reform. 
  2.2      BE IT FURTHER RESOLVED that the Secretary of State of the 
  2.3   State of Minnesota is directed to prepare copies of this 
  2.4   memorial and transmit them to Minnesota's Senators and 
  2.5   Representatives in Congress.
