  1.1                          A bill for an act 
  1.2             relating to education; prohibiting school districts 
  1.3             and the department of children, families, and learning 
  1.4             from accepting certain federal grants or grants from 
  1.5             nongovernmental organizations where the actual costs 
  1.6             of implementing the program exceed the grant amount; 
  1.7             amending Minnesota Statutes 2002, sections 123B.02, by 
  1.8             adding a subdivision; 127A.09, subdivision 1.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 123B.02, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 6a.  [GRANT PROGRAM FUNDS.] A school district may 
  1.13  accept funding from a voluntary federal grant program or from a 
  1.14  grant program of a nongovernmental organization only if the 
  1.15  department determines, and then notifies the district, that the 
  1.16  actual cost to the district of implementing the program will not 
  1.17  exceed the funding available for the program during the term of 
  1.18  the program. 
  1.19     [EFFECTIVE DATE.] This section is effective the day 
  1.20  following final enactment and applies to any district agreement 
  1.21  to participate in a voluntary federal grant program or a grant 
  1.22  program of a nongovernmental organization entered into or 
  1.23  modified after the effective date of this act. 
  1.24     Sec. 2.  Minnesota Statutes 2002, section 127A.09, 
  1.25  subdivision 1, is amended to read: 
  1.26     Subdivision 1.  [ACCEPTANCE.] (a) The commissioner may 
  1.27  accept and administer federal funds when such funds become 
  2.1   available that further public education and are consistent with 
  2.2   state policy and the mission of the department.  Acceptance of 
  2.3   the money is subject to department of finance policy and 
  2.4   procedure regarding federal funds. 
  2.5      (b) Notwithstanding paragraph (a), the commissioner may 
  2.6   accept funding from a voluntary federal grant program or from a 
  2.7   grant program of a nongovernmental organization only if the 
  2.8   commissioner determines, in consultation with the commissioner 
  2.9   of finance, that the actual cost to the state, school districts, 
  2.10  or both, if applicable, of implementing the program will not 
  2.11  exceed the funding available for the program during the term of 
  2.12  the program. 
  2.13     [EFFECTIVE DATE.] This section is effective the day 
  2.14  following final enactment and applies to any agreement to 
  2.15  participate in a voluntary federal grant program or a grant 
  2.16  program of a nongovernmental organization entered into or 
  2.17  modified after the effective date of this act.
