  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; modifying choices 
  1.3             relating to organ donation provided on driver's 
  1.4             license application; amending Minnesota Statutes 2002, 
  1.5             section 171.06, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 171.06, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [CONTENTS OF APPLICATION; OTHER INFORMATION.] (a) 
  1.10  An application must: 
  1.11     (1) state the full name, date of birth, sex, and residence 
  1.12  address of the applicant; 
  1.13     (2) as may be required by the commissioner, contain a 
  1.14  description of the applicant and any other facts pertaining to 
  1.15  the applicant, the applicant's driving privileges, and the 
  1.16  applicant's ability to operate a motor vehicle with safety; 
  1.17     (3) for a class C, class B, or class A driver's license, 
  1.18  state the applicant's social security number or, for a class D 
  1.19  driver's license, have a space for the applicant's social 
  1.20  security number and state that providing the number is optional, 
  1.21  or otherwise convey that the applicant is not required to enter 
  1.22  the social security number; 
  1.23     (4) contain a space where the applicant may indicate a 
  1.24  desire to make an anatomical gift according to paragraph (b); 
  1.25  and 
  2.1      (5) contain a notification to the applicant of the 
  2.2   availability of a living will/health care directive designation 
  2.3   on the license under section 171.07, subdivision 7.  
  2.4      (b) An applicant may elect to either (1) check "yes" to 
  2.5   make the anatomical gift, (2) check "no" to refuse to make an 
  2.6   anatomical gift, or (3) choose to allow a surviving family 
  2.7   member of the applicant to make the anatomical gift under 
  2.8   section 525.9212.  If the applicant does not indicate a desire 
  2.9   to make an anatomical gift when the application is made, the 
  2.10  applicant must be offered a donor document in accordance with 
  2.11  section 171.07, subdivision 5.  The application must contain 
  2.12  statements sufficient to comply with the requirements of the 
  2.13  Uniform Anatomical Gift Act (1987), sections 525.921 to 
  2.14  525.9224, so that execution of the application or donor document 
  2.15  will make the anatomical gift as provided in section 171.07, 
  2.16  subdivision 5, for those indicating a desire to make an 
  2.17  anatomical gift.  The application must be accompanied by 
  2.18  information describing Minnesota laws regarding anatomical gifts 
  2.19  and the need for and benefits of anatomical gifts, and the legal 
  2.20  implications of making an anatomical gift, including the law 
  2.21  governing revocation of anatomical gifts.  The commissioner 
  2.22  shall distribute a notice that must accompany all applications 
  2.23  for and renewals of a driver's license or Minnesota 
  2.24  identification card.  The notice must be prepared in conjunction 
  2.25  with a Minnesota organ procurement organization that is 
  2.26  certified by the federal Department of Health and Human Services 
  2.27  and must include: 
  2.28     (1) a statement that provides a fair and reasonable 
  2.29  description of the organ donation process, the care of the donor 
  2.30  body after death, and the importance of informing family members 
  2.31  of the donation decision; and 
  2.32     (2) a telephone number in a certified Minnesota organ 
  2.33  procurement organization that may be called with respect to 
  2.34  questions regarding anatomical gifts. 
  2.35     (c) The application must be accompanied also by information 
  2.36  containing relevant facts relating to:  
  3.1      (1) the effect of alcohol on driving ability; 
  3.2      (2) the effect of mixing alcohol with drugs; 
  3.3      (3) the laws of Minnesota relating to operation of a motor 
  3.4   vehicle while under the influence of alcohol or a controlled 
  3.5   substance; and 
  3.6      (4) the levels of alcohol-related fatalities and accidents 
  3.7   in Minnesota and of arrests for alcohol-related violations.
