  1.1                          A bill for an act 
  1.2             relating to consumer protection; requiring child 
  1.3             protective devices in shopping carts; providing 
  1.4             remedies and penalties; proposing coding for new law 
  1.5             in Minnesota Statutes, chapter 325E.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [325E.60] [SHOPPING CARTS; CHILD PROTECTIVE 
  1.8   DEVICES.] 
  1.9      Subdivision 1.  [DEFINITIONS.] For purposes of this 
  1.10  section, the following terms have the meanings given them: 
  1.11     (1) "child protective device" means a strap, device, or 
  1.12  piece of equipment designed, using reasonable engineering 
  1.13  standards, to prevent a child from falling out of a shopping 
  1.14  cart; and 
  1.15     (2) "seller" means a person who regularly sells goods at 
  1.16  retail. 
  1.17     Subd. 2.  [REQUIREMENT.] A seller that makes shopping carts 
  1.18  available for use by its customers shall equip and maintain not 
  1.19  less than 80 percent of the total number of shopping carts with 
  1.20  seats for children.  Each seat must be equipped with a child 
  1.21  protective device that is adjustable so as to secure a child of 
  1.22  average size ranging in age from six months to four years. 
  1.23     Subd. 3.  [REMEDIES AND PENALTIES.] A person who violates 
  1.24  this section is subject to the remedies and penalties under 
  1.25  section 8.31.
