  1.1                          A bill for an act 
  1.2             relating to human services; requiring licensure for 
  1.3             day care services to preschool and school age 
  1.4             children; amending Minnesota Statutes 1994, section 
  1.5             245A.03, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 245A.03, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [LICENSE REQUIRED.] Unless licensed by the 
  1.10  commissioner, an individual, corporation, partnership, voluntary 
  1.11  association, other organization, or controlling individual must 
  1.12  not: 
  1.13     (1) operate a residential or a nonresidential program; 
  1.14     (2) receive a child or adult for care, supervision, or 
  1.15  placement in foster care or adoption; 
  1.16     (3) help plan the placement of a child or adult in foster 
  1.17  care or adoption or engage in placement activities as defined in 
  1.18  section 259.21, subdivision 9, in this state, whether or not the 
  1.19  adoption occurs in this state; or 
  1.20     (4) advertise a residential or nonresidential program; or 
  1.21     (5) operate a residential or nonresidential day care 
  1.22  program for preschool or school age children, including latch 
  1.23  key child care programs. 
  1.24     Sec. 2.  [RULES PERTAINING TO CHILD CARE CENTERS.] 
  1.25     The commissioner of human services shall amend the rules 
  2.1   governing child care centers to reflect that a child may be 
  2.2   designated as an infant up to the age of 24 months.  The 
  2.3   amendment in this section is exempt from the rulemaking 
  2.4   provisions in Minnesota Statutes, chapter 14, but the 
  2.5   commissioner must comply with Minnesota Statutes, section 14.38, 
  2.6   subdivision 7.
