  1.1                          A bill for an act 
  1.2             relating to highways; authorizing counties to 
  1.3             designate county highways as cartways; amending 
  1.4             Minnesota Statutes 2002, section 163.11, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 163.11, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4a.  [DESIGNATION AS COUNTY CARTWAY.] A county board 
  1.10  that has vacated a county highway under subdivision 4 may 
  1.11  designate, as part of the vacating resolution, the former county 
  1.12  highway as a county cartway.  A highway designated as a county 
  1.13  cartway is a county highway for purposes of this chapter, but 
  1.14  the county board may not expend money from its road and bridge 
  1.15  fund on the maintenance or improvement of a county cartway 
  1.16  unless the county board determines that the expenditure is in 
  1.17  the public interest.
