  1.1                          A bill for an act
  1.2             relating to education; establishing a grant program 
  1.3             for student operated businesses; appropriating money; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 124C. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [124C.74] [STUDENT BUSINESS GRANTS.] 
  1.8      Subdivision 1.  [QUALIFICATION.] A school district that has 
  1.9   a student or school operated business may apply for a grant to 
  1.10  the commissioner of education for the purposes of the business 
  1.11  operations. 
  1.12     Subd. 2.  [ELIGIBLE BUSINESS.] To be eligible for a grant, 
  1.13  the student or school operated business must: 
  1.14     (1) have an educational purpose; 
  1.15     (2) provide service or products to customers or clients who 
  1.16  do not attend and are not employed by the sponsoring school; and 
  1.17     (3) meet the match requirements under subdivision 3.  
  1.18  Student participation in the program must apply towards 
  1.19  applicable secondary education requirements or be incorporated 
  1.20  into a youth apprenticeship program under chapter 126B.  
  1.21  Students participating in the school operated business are not 
  1.22  considered employees or public employees for the purposes of 
  1.23  chapters 43A, 176, 177, 179, 179A, 181, 197, and 353. 
  1.24     Subd. 3.  [MATCH REQUIREMENTS.] A school district must 
  1.25  obtain an equivalent match for a grant under this section from 
  2.1   private business sponsors.  The match may be either a cash or 
  2.2   in-kind contribution to the business operation. 
  2.3      Subd. 4.  [APPROVAL.] The commissioner of education may 
  2.4   approve or disapprove applications under this section for grants 
  2.5   up to $20,000.  The grant money must be used only for the 
  2.6   purposes of eligible school operated businesses. 
  2.7      Subd. 5.  [APPLICATION FORMS.] The commissioner of 
  2.8   education shall prepare application forms and establish 
  2.9   application dates. 
  2.10     Sec. 2.  [APPROPRIATIONS.] 
  2.11     The following amounts are appropriated from the general 
  2.12  fund to the department of education for the purposes of section 
  2.13  1 for the fiscal years designated.
