  1.1                          A bill for an act
  1.2             relating to education; restricting the number of 
  1.3             college credits beyond those needed for a degree for 
  1.4             which the state will pay; amending Minnesota Statutes 
  1.5             1996, section 135A.031, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 135A.031, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [APPROPRIATIONS FOR CERTAIN ENROLLMENTS.] The 
  1.10  state share of the estimated expenditures for instruction shall 
  1.11  vary for some categories of students, as designated in this 
  1.12  subdivision. 
  1.13     (a) The state must provide at least 67 percent of the 
  1.14  estimated expenditures for: 
  1.15     (1) students who resided in the state for at least one 
  1.16  calendar year prior to applying for admission or dependent 
  1.17  students whose parent or legal guardian resides in Minnesota at 
  1.18  the time the student applies; 
  1.19     (2) Minnesota residents who can demonstrate that they were 
  1.20  temporarily absent from the state without establishing residency 
  1.21  elsewhere; 
  1.22     (3) residents of other states or provinces who are 
  1.23  attending a Minnesota institution under a tuition reciprocity 
  1.24  agreement; and 
  1.25     (4) students who have been in Minnesota as migrant 
  2.1   farmworkers, as defined in the Code of Federal Regulations, 
  2.2   title 20, section 633.104, over a period of at least two years 
  2.3   immediately before admission or readmission to a Minnesota 
  2.4   public post-secondary institution, or students who are 
  2.5   dependents of such migrant farmworkers. 
  2.6      (b) The definition of full year equivalent for purposes of 
  2.7   the formula calculations in this chapter is twice the normal 
  2.8   value for the following enrollments: 
  2.9      (1) students who are concurrently enrolled in a public 
  2.10  secondary school and for whom the institution is receiving any 
  2.11  compensation under the post-secondary enrollment options act; 
  2.12  and 
  2.13     (2) students enrolled under the student exchange program of 
  2.14  the Midwest Compact. 
  2.15     (c) The state may not provide any of the estimated 
  2.16  expenditures for undergraduate students (1) who do not meet the 
  2.17  residency criteria under paragraph (a), or (2) at a state 
  2.18  university or the University of Minnesota who have completed, 
  2.19  without receiving a baccalaureate degree, 48 or more quarter 
  2.20  credits or the equivalent, applicable toward the degree, beyond 
  2.21  the number required for a baccalaureate in their major, or (3) 
  2.22  at a community college who have completed, without receiving an 
  2.23  associate degree, 24 or more credits or the equivalent, 
  2.24  applicable toward the degree, beyond the number required for an 
  2.25  associate degree.  Credits for courses in which a student 
  2.26  received a grade of "F" or "W" shall be counted toward this 
  2.27  maximum in clauses (2) and (3), as if the credits had been 
  2.28  earned. 
  2.29     Sec. 2.  [EFFECTIVE DATE.] 
  2.30     Section 1, paragraph (c), is effective July 1, 1997, for 
  2.31  students beginning classes as freshmen in a Minnesota public 
  2.32  community college.
