  1.1                          A bill for an act 
  1.2             relating to wages; providing a method of calculating 
  1.3             prevailing wage rates; amending Minnesota Statutes 
  1.4             1998, section 177.42, subdivision 6. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 177.42, 
  1.7   subdivision 6, is amended to read: 
  1.8      Subd. 6.  [PREVAILING WAGE RATE.] "Prevailing wage rate" 
  1.9   means the hourly basic rate of pay plus the contribution for 
  1.10  health and welfare benefits, vacation benefits, pension 
  1.11  benefits, and any other economic benefit paid to the largest 
  1.12  number at least 50 percent of workers engaged in the same class 
  1.13  of labor or, if there is no rate paid to at least 50 percent of 
  1.14  workers engaged in the same class of labor, the average of the 
  1.15  rates paid to all workers in the class, weighted by the total 
  1.16  employed at each rate within the area and.  "Prevailing wage 
  1.17  rate" includes, for the purposes of section 177.44, rental rates 
  1.18  for truck hire paid to those who own and operate the truck.  The 
  1.19  prevailing wage rate may not be less than a reasonable and 
  1.20  living wage.
