  1.1                          A bill for an act 
  1.2             relating to highways; exempting town roads, city 
  1.3             streets, and county highways from noise abatement 
  1.4             standards; amending Minnesota Statutes 1996, sections 
  1.5             116.07, subdivision 2a; and 161.125, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 116.07, 
  1.8   subdivision 2a, is amended to read: 
  1.9      Subd. 2a.  [EXEMPTIONS FROM STANDARDS.] No standards 
  1.10  adopted by any state agency for limiting levels of noise in 
  1.11  terms of sound pressure which may occur in the outdoor 
  1.12  atmosphere shall apply to (1) segments of trunk highways 
  1.13  constructed with federal interstate substitution money, provided 
  1.14  that all reasonably available noise mitigation measures are 
  1.15  employed to abate noise, (2) an existing or newly constructed 
  1.16  segment of a road, street, or highway, provided that all 
  1.17  reasonably available noise mitigation measures, as approved by 
  1.18  the commissioners of the department of transportation and 
  1.19  pollution control agency, are employed to abate noise under the 
  1.20  jurisdiction of a road authority of a town, statutory or home 
  1.21  rule charter city, or county, (3) skeet, trap, or shooting 
  1.22  sports clubs, or (4) motor vehicle race events conducted at a 
  1.23  facility specifically designed for that purpose that was in 
  1.24  operation on or before July 1, 1983.  Nothing herein shall 
  1.25  prohibit a local unit of government or a public corporation with 
  2.1   the power to make rules for the government of its real property 
  2.2   from regulating the location and operation of skeet, trap or 
  2.3   shooting sports clubs, or motor vehicle race events conducted at 
  2.4   a facility specifically designed for that purpose that was in 
  2.5   operation on or before July 1, 1983. 
  2.6      Sec. 2.  Minnesota Statutes 1996, section 161.125, 
  2.7   subdivision 1, is amended to read: 
  2.8      Subdivision 1.  [IMPLEMENTATION.] The commissioner of 
  2.9   transportation shall implement a noise abatement study and noise 
  2.10  abatement measures within or along the perimeter of state trunk 
  2.11  highways, freeways, and expressways in incorporated areas, 
  2.12  contingent on the availability of funding, in accordance with 
  2.13  section 116.07, subdivision 2a.  The commissioner shall report 
  2.14  to the legislature by February 1, 1997 July 1, 1998, on noise 
  2.15  abatement studies and measures undertaken during the 
  2.16  previous calendar fiscal year and planned for the next three 
  2.17  years under this subdivision.  The study must include a survey 
  2.18  of all applicable noise standards and feasible noise abatement 
  2.19  measures, and an evaluation of their ability to protect citizens.
  2.20     Sec. 3.  [EFFECTIVE DATE.] 
  2.21     Sections 1 and 2 are effective July 1, 1997.
