  1.1                          A bill for an act 
  1.2             relating to veterans; changing certain procedures for 
  1.3             making veterans service office grants; amending 
  1.4             Minnesota Statutes 2002, section 197.608, subdivisions 
  1.5             3, 4, 5, 6.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 197.608, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [ELIGIBILITY.] To be eligible for a grant under 
  1.10  this program, a county must: 
  1.11     (1) employ a county veterans service officer as authorized 
  1.12  by sections 197.60 and 197.606, who is certified to serve in 
  1.13  this position by the commissioner of veterans affairs; 
  1.14     (2) submit a written plan for the proposed expenditures to 
  1.15  enhance the functioning of the county veterans service office in 
  1.16  accordance with the program rules; and 
  1.17     (3) apply for the grant according to procedures to be 
  1.18  established for this program by the commissioner and the 
  1.19  Minnesota Association of County Veterans Service Officers, and 
  1.20  receive written approval from the commissioner for the grant in 
  1.21  advance of making the proposed expenditures. 
  1.22     Sec. 2.  Minnesota Statutes 2002, section 197.608, 
  1.23  subdivision 4, is amended to read: 
  1.24     Subd. 4.  [GRANT APPLICATION.] (a) A grant application must 
  1.25  be submitted to the department of veterans affairs according to 
  2.1   procedures to be established by the commissioner in consultation 
  2.2   with the Minnesota Association of County Veterans Service 
  2.3   Officers.  The grant application must include a specific 
  2.4   description of the plan for enhancing the operation of the 
  2.5   county veterans service office. 
  2.6      (b) The commissioner A committee consisting of members of 
  2.7   the Minnesota Association of County Veterans Service Officers 
  2.8   and the commissioner shall approve a grant application only if 
  2.9   it meets the criteria for eligibility as established and 
  2.10  announced by the commissioner and there are sufficient funds 
  2.11  remaining in the grant program to cover the amount of the 
  2.12  grant.  The commissioner may request modification of a plan.  If 
  2.13  the commissioner committee rejects a grant application, written 
  2.14  reasons for the rejection must be provided to the applicant 
  2.15  county and the county may modify the application and resubmit it.
  2.16     Sec. 3.  Minnesota Statutes 2002, section 197.608, 
  2.17  subdivision 5, is amended to read: 
  2.18     Subd. 5.  [QUALIFYING USES.] The commissioner of veterans 
  2.19  affairs committee designated in subdivision 4 shall determine 
  2.20  whether the plan specified in the grant application will enable 
  2.21  the applicant county to enhance the effectiveness of its county 
  2.22  veterans office. 
  2.23     Notwithstanding subdivision 3, clause (1), a county may 
  2.24  apply for and use a grant for the training and education 
  2.25  required by the commissioner for a newly employed county 
  2.26  veterans service officer's certificate, or for the continuing 
  2.27  education of other staff. 
  2.28     Sec. 4.  Minnesota Statutes 2002, section 197.608, 
  2.29  subdivision 6, is amended to read: 
  2.30     Subd. 6.  [GRANT AMOUNT.] The amount of each grant must be 
  2.31  determined by the commissioner of veterans affairs, and may not 
  2.32  exceed the lesser of: 
  2.33     (1) the amount specified in the grant application to be 
  2.34  expended on the plan for enhancing the effectiveness of the 
  2.35  county veterans service office; or 
  2.36     (2) the county's share of the total funds available under 
  3.1   the program, determined in the following manner: 
  3.2      (i) if the county's veteran population is less than 1,000, 
  3.3   the county's grant share shall be $2,000; 
  3.4      (ii) if the county's veteran population is 1,000 or more 
  3.5   but less than 3,000, the county's grant share shall be $4,000; 
  3.6      (iii) if the county's veteran population is 3,000 or more 
  3.7   but less then 10,000, the county's grant share shall be $6,000; 
  3.8   or 
  3.9      (iv) if the county's veteran population is 10,000 or more, 
  3.10  the county's grant share shall be $8,000. 
  3.11     In any year, only one-half of the counties in each of the 
  3.12  four veteran population categories (i) to (iv) may be awarded 
  3.13  grants.  Grants shall be awarded on a first-come first-served 
  3.14  basis to counties submitting applications which meet the 
  3.15  commissioner's criteria as established in the rules.  Any county 
  3.16  not receiving a grant in any given year shall receive priority 
  3.17  consideration for a grant the following year.  
  3.18     In any year, after a period of time to be determined by the 
  3.19  commissioner, any amounts remaining from undistributed county 
  3.20  grant shares may must be reallocated to the other counties which 
  3.21  have submitted qualifying application. 
  3.22     The veteran population of each county shall be determined 
  3.23  by the figure supplied by the United States Department of 
  3.24  Veterans Affairs, as adopted by the commissioner.
