  1.1                          A bill for an act 
  1.2             relating to education finance; adding a nonresident 
  1.3             pupil transportation levy; amending Minnesota Statutes 
  1.4             2000, section 123B.88, by adding a subdivision.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 123B.88, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 23.  [NONRESIDENT PUPIL TRANSPORTATION LEVY.] A 
  1.9   school district may levy for the actual cost of transporting a 
  1.10  nonresident pupil between home and school, if the following 
  1.11  criteria are met: 
  1.12     (1) the school that the pupil was attending prior to 
  1.13  enrolling in the nonresident district under this section was 
  1.14  closed; 
  1.15     (2) the distance from the closed school to the next nearest 
  1.16  school in the district that the pupil could attend is at least 
  1.17  20 miles; 
  1.18     (3) the pupil's residence is at least 20 miles from any 
  1.19  school that the pupil could attend in the resident district; and 
  1.20     (4) the pupil's residence is closer to the school of 
  1.21  attendance in the nonresident district than to any school the 
  1.22  pupil could attend in the resident district. 
  1.23     [EFFECTIVE DATE.] This section is effective July 1, 2001.
