  1.1                          A bill for an act 
  1.2             relating to transportation; proposing amendment to 
  1.3             Minnesota Constitution, article XIV, by adding a 
  1.4             section to require 32 percent of motor vehicle sales 
  1.5             tax proceeds be deposited in highway user tax 
  1.6             distribution fund; and appropriating money to improve 
  1.7             transit, reduce traffic congestion, and enhance 
  1.8             interregional corridors. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.11     An amendment to the Minnesota Constitution, article XIV, is 
  1.12  proposed to the people.  If adopted, article XIV will be amended 
  1.13  by adding a section to read: 
  1.14     Sec. 12.  At least 32 percent of the proceeds of any tax 
  1.15  levied by law on the purchase price of new and used motor 
  1.16  vehicles must be deposited in the highway user tax distribution 
  1.17  fund. 
  1.18     Sec. 2.  [SUBMISSION TO VOTERS.] 
  1.19     The constitutional amendment proposed in section 1 must be 
  1.20  submitted to the people at the 2002 general election.  The 
  1.21  question submitted must be: 
  1.22     "Shall the Minnesota Constitution be amended to require 
  1.23  that at least 32 percent of the proceeds from any sales tax on 
  1.24  new and used motor vehicles be deposited in the highway user tax 
  1.25  distribution fund? 
  1.26                                     Yes .......
  1.27                                     No ........"
  2.1      Sec. 3.  [APPROPRIATIONS FOR TRANSPORTATION PURPOSES.] 
  2.2      (a) $85,000,000 is appropriated for the fiscal year ending 
  2.3   June 30, 2002, and $85,000,000 is appropriated for the fiscal 
  2.4   year ending June 30, 2003, from the general fund to the 
  2.5   commissioner of transportation to be spent as follows: 
  2.6      (1) $21,000,000 the first year and $21,000,000 the second 
  2.7   year are for advances in and improvements to bus transit systems 
  2.8   by focusing on projects that efficiently give the greatest 
  2.9   number of people reliable, safe, alternative transportation 
  2.10  options. 
  2.11     (2) $32,000,000 the first year and $32,000,000 the second 
  2.12  year are for the removal of traffic bottlenecks by focusing on 
  2.13  reducing traffic congestion through improvements and expansion 
  2.14  of beltways and interstate connections in the metropolitan area, 
  2.15  as defined in Minnesota Statutes, section 473.121. 
  2.16     (3) $32,000,000 the first year and $32,000,000 the second 
  2.17  year are for enhancing and improving interregional corridor 
  2.18  highway systems. 
  2.19     (b) If an appropriation for either year is not spent, it is 
  2.20  available for expenditure in any subsequent year, except as 
  2.21  provided in paragraph (c).  This appropriation does not lapse, 
  2.22  except as otherwise provided in paragraph (c). 
  2.23     (c) The commissioner of transportation shall let contracts 
  2.24  for at least 60 percent of the $170,000,000 total appropriation 
  2.25  made in paragraph (a) before July 1, 2004, toward accomplishing 
  2.26  the objectives stated in paragraph (a), clauses (1) to (3).  If 
  2.27  this requirement is not satisfied, the remaining unexpended and 
  2.28  unobligated appropriation cancels to the general fund.
