A bill for an act
relating to local government; providing and clarifying the compatibility of
concurrently holding certain offices; amending Minnesota Statutes 2012, section
375.09, subdivision 1; proposing coding for new law in Minnesota Statutes,
chapter 123B; repealing Minnesota Statutes 2012, section 367.033.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

[123B.196] COMPATIBILITY OF SCHOOL BOARD OFFICE WITH
OTHER ELECTED OFFICES.

A school board member of a school district, however organized, may serve
concurrently as a member of a city council, a board of county commissioners, or a town
board.

Sec. 2.

Minnesota Statutes 2012, section 375.09, subdivision 1, is amended to read:


Subdivision 1.

No county employment or other elected office; school district
office exception
.

Except as authorized under section 123B.196 for service on a school board, no county commissioner shall hold another elected office during tenure as
commissioner nor be employed by the county.

Sec. 3. REPEALER.

Minnesota Statutes 2012, section 367.033, is repealed.
