  1.1                          A bill for an act 
  1.2             relating to civil law; exempting harassment 
  1.3             restraining order actions from mandatory alternative 
  1.4             dispute resolution requirements; amending Minnesota 
  1.5             Statutes 2002, section 484.76, subdivision 1.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 484.76, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [GENERAL.] The supreme court shall 
  1.10  establish a statewide alternative dispute resolution program for 
  1.11  the resolution of civil cases filed with the courts.  The 
  1.12  supreme court shall adopt rules governing practice, procedure, 
  1.13  and jurisdiction for alternative dispute resolution programs 
  1.14  established under this section.  Except for matters involving 
  1.15  family law and harassment restraining order actions under 
  1.16  section 609.748, the rules shall require the use of nonbinding 
  1.17  alternative dispute resolution processes in all civil cases, 
  1.18  except for good cause shown by the presiding judge, and must 
  1.19  provide an equitable means for the payment of fees and expenses 
  1.20  for the use of alternative dispute resolution processes.
