  1.1                          A bill for an act 
  1.2             relating to the environment; increasing the license 
  1.3             fee for individual sewage treatment system 
  1.4             contractors; imposing a surcharge; requiring a report; 
  1.5             increasing the number of positions administering the 
  1.6             individual sewage treatment system program; amending 
  1.7             Minnesota Statutes 2002, section 115.56, subdivision 
  1.8             4; proposing coding for new law in Minnesota Statutes, 
  1.9             chapter 115. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 2002, section 115.56, 
  1.12  subdivision 4, is amended to read: 
  1.13     Subd. 4.  [LICENSE FEE.] The fee for a license required 
  1.14  under subdivision 2 is $100 $200 per year.  The maximum total 
  1.15  for multiple licenses is $500.  Revenue from the fees must be 
  1.16  credited to the environmental fund and used to administer 
  1.17  sections 115.55 to 115.58. 
  1.18     Sec. 2.  [115.551] [TANK SURCHARGE.] 
  1.19     A surcharge of $25 is imposed on the sale of each septic 
  1.20  system tank.  The surcharge must be paid with the tax imposed on 
  1.21  the retail sale of a tank, as retail sale is defined in section 
  1.22  297A.61, subdivision 4.  The commissioner of revenue has the 
  1.23  same powers to collect the surcharge and to impose penalties 
  1.24  that are given to the commissioner with respect to the 
  1.25  collection of sales taxes in chapters 297A and 289A.  Proceeds 
  1.26  from the surcharge collection must be deposited in the 
  1.27  environmental fund and used to administer sections 115.55 to 
  2.1   115.58. 
  2.2      Sec. 3.  [INDUSTRY OVERSIGHT COMMITTEE; REPORT.] 
  2.3      The commissioner of the pollution control agency shall, in 
  2.4   consultation with the individual sewage treatment system 
  2.5   industry, propose a structure for an industry oversight board 
  2.6   that will work with the commissioner on industry oversight.  The 
  2.7   commissioner shall report to the committees of the legislature 
  2.8   with jurisdiction over environmental issues on the proposal and 
  2.9   any other steps the commissioner has taken with respect to 
  2.10  industry oversight by January 1, 2004.  
  2.11     Sec. 4.  [COMPLEMENT; POLLUTION CONTROL AGENCY.] 
  2.12     The complement of the pollution control agency is increased 
  2.13  by four positions to administer the individual sewage treatment 
  2.14  system program. 
  2.15     Sec. 5.  [EFFECTIVE DATE.] 
  2.16     Sections 1 to 4 are effective July 1, 2003.
