  1.1                          A bill for an act 
  1.2             relating to education; modifying provision for 
  1.3             textbooks and instructional materials for loan to 
  1.4             nonpublic school pupils; amending Minnesota Statutes 
  1.5             2000, section 123B.43.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 123B.43, is 
  1.8   amended to read: 
  1.9      123B.43 [USE OF INDIVIDUALIZED INSTRUCTIONAL MATERIALS.] 
  1.10     (a) The commissioner shall assure that textbooks and 
  1.11  individualized instructional materials loaned to nonpublic 
  1.12  school pupils are secular, neutral, nonideological and that they 
  1.13  are incapable of diversion for religious use.  
  1.14     (b) Textbooks and individualized instructional materials 
  1.15  must not be used in religious courses, devotional exercises, 
  1.16  religious training or any other religious activity.  
  1.17     (c) Textbooks and individualized instructional materials 
  1.18  must be loaned only to individual pupils upon the request of a 
  1.19  parent or guardian or the pupil on a form designated for this 
  1.20  use by the commissioner.  The request forms shall provide for 
  1.21  verification by the parent or guardian or pupil that the 
  1.22  requested textbooks and individualized instructional materials 
  1.23  are for the use of the individual pupil in connection with a 
  1.24  program of instruction in the pupil's elementary or secondary 
  1.25  school.  
  2.1      (d) The servicing school district or the intermediary 
  2.2   service area must take adequate measures to ensure an accurate 
  2.3   and periodic inventory of all textbooks and individualized 
  2.4   instructional materials loaned to elementary and secondary 
  2.5   school pupils attending nonpublic schools.  The commissioner of 
  2.6   children, families, and learning shall promulgate rules under 
  2.7   the provisions of chapter 14 to terminate the eligibility of any 
  2.8   nonpublic school pupil if the commissioner determines, after 
  2.9   notice and opportunity for hearing, that the textbooks or 
  2.10  individualized instructional materials have been used in a 
  2.11  manner contrary to the provisions of section 123B.41, 
  2.12  subdivision 5, 123B.42, or this section or any rules promulgated 
  2.13  by the commissioner of children, families, and learning. 
  2.14     (e) Nothing contained in section 123B.41, subdivision 5, 
  2.15  123B.42, or this section shall be construed to authorize the 
  2.16  making of any payments to a nonpublic school or its faculty, 
  2.17  staff or administrators for religious worship or instruction or 
  2.18  for any other purpose.
