  1.1                          A bill for an act 
  1.2             relating to consumer protection; prohibiting certain 
  1.3             unsolicited telephone calls at certain times of day; 
  1.4             amending Minnesota Statutes 1998, sections 325E.26, by 
  1.5             adding a subdivision; and 325E.30. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 325E.26, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3a.  [NONCOMMERCIAL TELEPHONE SOLICITATION.] 
  1.10  "Noncommercial telephone solicitation" means an unsolicited call 
  1.11  to a residential subscriber if the call is not a commercial 
  1.12  telephone solicitation and the purpose of the call is to solicit 
  1.13  a donation from the subscriber or to solicit the purchase of 
  1.14  goods or services by the subscriber.  This section does not 
  1.15  apply to calls in which the organization or person initiating 
  1.16  the call has a prior personal or business relationship with the 
  1.17  subscriber. 
  1.18     Sec. 2.  Minnesota Statutes 1998, section 325E.30, is 
  1.19  amended to read: 
  1.20     325E.30 [TIME OF DAY LIMIT.] 
  1.21     A caller shall not use an automatic dialing-announcing 
  1.22  device nor make any commercial telephone solicitation or 
  1.23  noncommercial telephone solicitation before 9:00 a.m. or after 
  1.24  9:00 p.m. on any day, between 5:30 p.m. and 7:30 p.m. on any 
  1.25  weekday, or at any time on any Sunday.
