  1.1                          A bill for an act 
  1.2             relating to local government; clarifying the 
  1.3             definition of property owner; amending Minnesota 
  1.4             Statutes 1996, section 414.011, subdivision 5. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 414.011, 
  1.7   subdivision 5, is amended to read: 
  1.8      Subd. 5.  (a) "Property owner" means the fee owner of land, 
  1.9   or the beneficial owner of land whose interest is primarily one 
  1.10  of possession and enjoyment.  The term includes, but is not 
  1.11  limited to, vendors and vendees under a contract for deed, and 
  1.12  mortgagors.  Any reference to a percentage of property owners 
  1.13  shall mean in number.  
  1.14     (b) In determining a number from which a certain percentage 
  1.15  is required, the vendor and vendee together must be counted as 
  1.16  one.  In the counting to meet the percentage requirements for a 
  1.17  petition, the two, counted as one, must agree to the same 
  1.18  action; otherwise, neither may be counted for or against any 
  1.19  petition proposition.
