A bill for an act
relating to elections; soil and water conservation
district supervisors; providing for election of
certain supervisors and appointment of certain
supervisors; amending Minnesota Statutes 2004,
sections 103C.311, by adding a subdivision; 103C.315,
subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 103C.311, is
amended by adding a subdivision to read:

new text begin Elected or appointed supervisors in certain
districts.

new text begin Notwithstanding subdivision 1, and in addition to
the provisions of subdivision 2, if the boundaries of a soil and
water conservation district coincide with the boundaries of one
county, this subdivision applies. In order to have elected
supervisors, the district board must consist of the same number
of members as the county board, and the boundaries of the
supervisor districts must coincide with the boundaries of the
county commissioner districts. If the county board does not
provide for the district board to consist of the same number of
members as the county board and be elected from districts whose
boundaries coincide with county commissioner districts, the
county board must appoint the members of the district board.

Sec. 2.

Minnesota Statutes 2004, section 103C.315,
subdivision 1, is amended to read:


Subdivision 1.

Members.

(a) Except as provided in
paragraph (c), the district board shall consist of five
supervisors, elected or appointed as provided in sections
103C.201, subdivision 8, deleted text begin and deleted text end 103C.305new text begin , and 103C.311, subdivision

(b) Supervisors must be eligible voters residing in the
district.

(c) In counties where the county board consists of seven
members and districts have been divided into supervisor
districts, under section 103C.311, subdivision 2, the county
board may establish seven supervisor districts, elected or
appointed as provided in sections 103C.201, subdivision 8;
103C.305; and 103C.311, deleted text begin subdivision deleted text end new text begin subdivisions new text end 2 new text begin and 3new text end .

Sec. 3. new text begin EFFECTIVE DATE; TRANSITION.

new text begin Sections 1 and 2 are effective August 1, 2005, and apply to
elections for soil and water conservation district supervisors
at the state general election in 2006 and after.

new text begin To achieve staggered terms after the effective date for
supervisors elected at large before the effective date and by
district after that date, the district board shall determine by
lot which terms must be filled for a two-year term, a four-year
term, or a six-year term at the 2006 state general election.
