A bill for an act
relating to state government; establishing an Americans with Disabilities Act
Notice to Businesses Working Group; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. AMERICANS WITH DISABILITIES ACT NOTICE TO BUSINESSES
WORKING GROUP.

Subdivision 1.

Establishment.

The Americans with Disabilities Act Notice to Businesses
Working Group is established to develop recommendations for providing notice to business
owners that standard building code inspections, plan reviews, and approvals do not guarantee
complete compliance with the accessibility requirements of the Americans with Disabilities
Act, the Minnesota Human Rights Act, or state building codes.

Subd. 2.

Working group.

(a) The working group shall consist of 13 members as follows:

(1) one member appointed by the Minnesota Department of Human Rights;

(2) one member appointed by the Minnesota State Council on Disability;

(3) one member appointed by the Association of Minnesota Building Officials;

(4) one member appointed by the League of Minnesota Cities;

(5) one member appointed by the Association of Minnesota Counties;

(6) one member appointed by the American Society of Civil Engineers;

(7) one member appointed by the American Institute of Architects;

(8) one member appointed by the American Society of Landscape Architects;

(9) one member appointed by the Minnesota Chamber of Commerce;

(10) one member appointed by the National Federation of Independent Business;

(11) one member appointed by the MetroIBA;

(12) one member appointed by the Minnesota Disability Law Center; and

(13) the commissioner of labor and industry or a designee.

(b) Any public member may designate a substitute from the same organization to replace
that member at a meeting of the working group.

Subd. 3.

Duties.

The working group must develop recommendations to determine:

(1) the content, form, and timing of the notice; and

(2) the appropriate entity or entities responsible for providing the notice.

Subd. 4.

Administrative support.

The commissioner of labor and industry shall provide
administrative support and meeting space for the working group.

Subd. 5.

Compensation.

Members of the working group serve without compensation
and shall not be reimbursed for expenses.

Subd. 6.

Chair.

The commissioner of labor and industry or the commissioner's designee
shall serve as chair of the working group.

Subd. 7.

Meetings.

The working group shall meet as necessary and at the call of the
chair. Meetings of the working group are subject to Minnesota Statutes, chapter 13D.

Subd. 8.

Appointments; first meeting.

Appointments to the working group must be
made by July 1, 2019. The commissioner of labor and industry must convene the first
meeting by August 30, 2019.

Subd. 9.

Report to legislature.

By January 15, 2020, the commissioner of labor and
industry shall submit a report detailing the working group's findings and recommendations
to the chairs and ranking minority members of the committees with jurisdiction in the senate
and in the house of representatives. The report must include any draft legislation necessary
to implement the recommendations of the working group.

EFFECTIVE DATE.

This section is effective the day following final enactment.
