  1.1                          A bill for an act 
  1.2             relating to education; regarding notification to 
  1.3             teachers that are in contact with students with 
  1.4             histories of violent behavior; amending Minnesota 
  1.5             Statutes 2002, section 121A.64. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 121A.64, is 
  1.8   amended to read: 
  1.9      121A.64 [NOTIFICATION; TEACHERS' LEGITIMATE EDUCATIONAL 
  1.10  INTEREST.] 
  1.11     (a) A classroom teacher has a legitimate educational 
  1.12  interest in knowing which students placed in the teacher's 
  1.13  classroom have a history of violent behavior and must be 
  1.14  notified before such students are placed in the teacher's 
  1.15  classroom. 
  1.16     (b) Representatives of the school board and the exclusive 
  1.17  representative of the teachers shall discuss issues related to 
  1.18  notification prior to placement the model policy posted on the 
  1.19  information policy analysis Web site for notifying classroom 
  1.20  teachers and other school district employees having a legitimate 
  1.21  educational interest in knowing about students with a history of 
  1.22  violent behavior placed in classrooms of students with histories 
  1.23  of violent behavior and any.  The representatives of the school 
  1.24  board and the exclusive representative of the teachers also may 
  1.25  discuss the need for intervention services or conflict 
  2.1   resolution or training for staff in these cases related to 
  2.2   placing students with a history of violent behavior in teachers' 
  2.3   classrooms. 
  2.4      [EFFECTIVE DATE.] This section is effective for the 
  2.5   2003-2004 school year and later.  
  2.6      Sec. 2.  [POLICY ON STUDENTS WITH A HISTORY OF VIOLENT 
  2.7   BEHAVIOR.] 
  2.8      (a) Representatives of the Minnesota school boards 
  2.9   association, Education Minnesota, and the information policy 
  2.10  analysis division in the Minnesota department of administration, 
  2.11  in consultation with two legislators, one a member of the house 
  2.12  of representatives appointed by the speaker of the house and one 
  2.13  a member of the senate appointed by the subcommittee on 
  2.14  committees, shall develop a model policy by August 1, 2003, on 
  2.15  notifying classroom teachers and other school district employees 
  2.16  having a legitimate educational interest when a student with a 
  2.17  history of violent behavior is placed in the teacher's 
  2.18  classroom.  The model policy at least must: 
  2.19     (1) define what constitutes a history of violent behavior, 
  2.20  consistent with Minnesota Statutes, section 121A.45, subdivision 
  2.21  2, clause (c); 
  2.22     (2) limit reports on violent behavior to a specified number 
  2.23  of school years; 
  2.24     (3) define "legitimate educational interest," consistent 
  2.25  with Minnesota Statutes, section 121A.64; 
  2.26     (4) indicate the persons at the school or district level 
  2.27  who determine which school district employees have a legitimate 
  2.28  educational interest; and 
  2.29     (5) require school districts that transfer the student 
  2.30  records of a student with a history of violent behavior to 
  2.31  another school district, charter school, or alternative 
  2.32  education program to include all information about the student's 
  2.33  history of violent behavior in the student's educational records 
  2.34  it transmits to the enrolling school district, charter school, 
  2.35  or alternative education program, consistent with this policy. 
  2.36     (b) The information policy analysis division in the 
  3.1   Minnesota department of administration by August 15, 2003, must 
  3.2   post on its division Web site the model policy developed under 
  3.3   paragraph (a). 
  3.4      [EFFECTIVE DATE.] This section is effective the day 
  3.5   following final enactment.
