  1.1                          A bill for an act 
  1.2             relating to human services; recalculating the 
  1.3             capitation payments to Itasca county; amending 
  1.4             Minnesota Statutes 2002, section 256B.692, subdivision 
  1.5             4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 256B.692, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [PAYMENTS TO COUNTIES.] (a) The commissioner 
  1.10  shall pay counties that are purchasing or providing health care 
  1.11  under this section a per capita payment for all enrolled 
  1.12  recipients.  Payments shall not exceed payments that otherwise 
  1.13  would have been paid to health plans under medical assistance 
  1.14  and general assistance medical care for that county or region.  
  1.15  This payment is in addition to any administrative allocation to 
  1.16  counties for education, enrollment, and advocacy.  The state of 
  1.17  Minnesota and the United States Department of Health and Human 
  1.18  Services are not liable for any costs incurred by a county that 
  1.19  exceed the payments to the county made under this subdivision.  
  1.20  A county whose costs exceed the payments made by the state, or 
  1.21  any affected enrollees or creditors of that county, shall have 
  1.22  no rights under chapter 61B or section 62D.181.  A county may 
  1.23  assign risk for the cost of care to a third party. 
  1.24     (b) The commissioner shall recalculate capitation risk 
  1.25  adjustment factors based on complete encounter data for Itasca 
  2.1   county for the four quarters of July-September 2001, 
  2.2   October-December 2001, January-March 2002, and April-June 2002, 
  2.3   and shall pay the additional risk adjustment capitation amount 
  2.4   due to Itasca county for services provided to enrollees and for 
  2.5   which the county has reimbursed medical providers.
