1.1 A bill for an act 1.2 relating to motor vehicles; consumer protection; 1.3 applying odometer disclosure laws to motor vehicles, 1.4 regardless of age; making technical changes; amending 1.5 Minnesota Statutes 1994, section 325E.15; repealing 1.6 Minnesota Rules 1993, part 7402.0500, item (c). 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1994, section 325E.15, is 1.9 amended to read: 1.10 325E.15 [TRANSFER OF MOTOR VEHICLE; MILEAGE DISCLOSURE.] 1.11 No person shall transfer a motor vehicle without disclosing 1.12 in writing to the transferee the true mileage registered on the 1.13 odometer reading or that the actual mileage is unknown if the 1.14 odometer reading is known by the transferor to be different from 1.15 the true mileage. The registrar of motor vehicles shall adopt, 1.16 pursuant to the administrative procedure act, rules not 1.17 inconsistent with sections 325E.13 to 325E.16 or United States 1.18 Code, titleIV of the Federal Motor Vehicle Information and Cost1.19Savings Act15, chapter 46, subchapter IV or anyrulesfederal 1.20 regulations promulgated thereunder prescribing the manner in 1.21 which such written disclosure shall be made; except that the 1.22 exemption provided in Code of Federal Regulations, title 49, 1.23 section 580.6, paragraph (a)(3), is specifically not 1.24 incorporated by reference and the registrar shall not adopt any 1.25 rule that would exempt a motor vehicle from the application of 1.26 this section due solely to its age. No transferor shall violate 2.1 any rules adopted under this section or knowingly give a false 2.2 statement to a transferee in making any disclosure required by 2.3 such rules. 2.4 Sec. 2. [REPEALER.] 2.5 Minnesota Rules 1993, part 7402.0500, item (c), is repealed. 2.6 Sec. 3. [EFFECTIVE DATE.] 2.7 Sections 1 and 2 are effective the day following final 2.8 enactment.
