  1.1                          A bill for an act 
  1.2             relating to game and fish; allowing the baiting of 
  1.3             deer during archery season under certain conditions; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 97B. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [97B.331] [BAITING DEER DURING ARCHERY SEASON.] 
  1.8      Subdivision 1.  [DEFINITIONS.] (a) The definitions in this 
  1.9   subdivision apply to this section. 
  1.10     (b) "Bait" means grains, fruits, vegetables, nuts, hay, or 
  1.11  other food transported and placed for the purpose of attracting 
  1.12  and enticing deer, but does not include scents, salt, minerals, 
  1.13  or food resulting from on-site land management activities. 
  1.14     (c) "Minimum-maintenance road" means a road designated 
  1.15  under section 89.71, subdivision 5, or 160.095. 
  1.16     Subd. 2.  [BAITING OF DEER ALLOWED; RESTRICTIONS.] 
  1.17  Notwithstanding section 609.68, a person may place bait to take 
  1.18  deer by archery during the open archery season only.  To attract 
  1.19  deer a person may not use bait: 
  1.20     (1) containing more than ten gallons of material per site; 
  1.21     (2) with solid waste containing bottles, cans, plastic, 
  1.22  paper, or metal; 
  1.23     (3) containing materials that are not readily 
  1.24  biodegradable; 
  1.25     (4) within 100 yards of a public road other than a 
  2.1   minimum-maintenance road; 
  2.2      (5) within 50 yards of a minimum-maintenance road or a 
  2.3   trail that is open to the public; 
  2.4      (6) within 200 yards of an existing bait site; or 
  2.5      (7) with an automated feeding device.
