A bill for an act
relating to metropolitan government; providing
additional oversight responsibilities for the
Legislative Commission on Metropolitan Government;
amending Minnesota Statutes 2004, sections 3.8841, by
adding subdivisions; 473.246.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 3.8841, is
amended by adding a subdivision to read:

new text begin Metropolitan council review of comprehensive
plans; oversight.

new text begin The commission must monitor, review, and make
recommendations to the Metropolitan Council and the legislature
with regard to all cases in which the Metropolitan Council
requires a local governmental unit to change any comprehensive
plan under section 473.175.

Sec. 2.

Minnesota Statutes 2004, section 3.8841, is
amended by adding a subdivision to read:

new text begin Metropolitan council services and approvals;
oversight.

recommendations to the Metropolitan Council and the legislature
with regard to all cases in which the Metropolitan Council
proposes to deny a local unit of government any of the services
or approvals under its control that are necessary for the
implementation of an approved comprehensive plan.

Sec. 3.

Minnesota Statutes 2004, section 473.246, is
amended to read:


473.246 COUNCIL'S SUBMISSIONS TO LEGISLATIVE COMMISSION.

The Metropolitan
Council shall submit to the Legislative Commission on
Metropolitan Government information onnew text begin :

new text begin (1) new text end the council's tax rates and dollar amounts levied for

plan pursuant to section 473.175;

services or approvals under its control that are necessary for
the implementation of an approved comprehensive plan;

review by the legislative commission, as provided in section
3.8841.

new text begin If the Legislative Commission on
Metropolitan Government votes to advise the Metropolitan Council
that an action of the council under subdivision 1, clause (6) or
(7), should not be enforced, the council must not enforce that
action until 30 days after the legislature has convened for its
next annual session.
