  1.1                          A bill for an act
  1.2             relating to state government; revising certain 
  1.3             requirements related to consultant contracts; 
  1.4             transferring duties from the commissioner of 
  1.5             administration to the commissioner of finance; 
  1.6             amending Minnesota Statutes 1994, sections 3.98, by 
  1.7             adding a subdivision; and 16B.17, subdivision 4. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 3.98, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  If an agency affected by a bill anticipates that 
  1.12  it will contract for professional or technical services as a 
  1.13  result of the bill, the agency preparing the fiscal note must 
  1.14  compare the anticipated cost of the contract with the cost that 
  1.15  would be incurred if the services were to be provided by state 
  1.16  employees. 
  1.17     Sec. 2.  Minnesota Statutes 1994, section 16B.17, 
  1.18  subdivision 4, is amended to read: 
  1.19     Subd. 4.  [REPORTS.] (a) The commissioner shall submit to 
  1.20  the governor and the legislature a monthly listing of all 
  1.21  contracts for consultant services and for professional and 
  1.22  technical services on which work is currently being performed.  
  1.23  The monthly listing must indicate which contracts were executed 
  1.24  or disapproved in the preceding month and must indicate any 
  1.25  proposed contracts that the commissioner disapproved that month. 
  1.26     (b) The monthly report must identify:  the parties and, 
  2.1   including any subcontractors; the contract total amount, 
  2.2   duration, and to be paid under the contract and the hourly or 
  2.3   daily rate, as applicable; the starting date and scheduled 
  2.4   ending date; tasks to be performed; the total paid to the 
  2.5   contractor during the preceding month; and the cost of any 
  2.6   expenses and training paid on behalf of the contractor.  
  2.7      (c) The commissioner shall also issue quarterly annual 
  2.8   reports summarizing the contract review activities of the 
  2.9   department during the preceding quarter year.  The annual 
  2.10  reports also must summarize and aggregate the data in the 
  2.11  monthly reports for that year.  The annual reports must list the 
  2.12  total amount spent by each agency on consultant or professional 
  2.13  and technical service contracts during the previous year and the 
  2.14  aggregate amount paid to each contractor by all state agencies 
  2.15  combined. 
  2.16     (d) The commissioner must make each report required under 
  2.17  this section available free of charge.  
  2.18     Sec. 3.  [TRANSFER.] 
  2.19     The duties of the commissioner of administration related to 
  2.20  review and approval of contracts for consultant or professional 
  2.21  and technical services are transferred to the commissioner of 
  2.22  finance under Minnesota Statutes, section 15.039. 
  2.23     Sec. 4.  [RECODIFICATION.] 
  2.24     In the next and subsequent editions of Minnesota Statutes, 
  2.25  the Revisor of Statutes shall recodify Minnesota Statutes, 
  2.26  section 16B.17 into Minnesota Statutes, chapter 16A, so that the 
  2.27  term "commissioner" as used in that section refers to the 
  2.28  commissioner of finance. 
  2.29     Sec. 5.  [EFFECTIVE DATE.] 
  2.30     Sections 1 to 4 are effective July 1, 1995.
