  1.1                          A bill for an act 
  1.2             relating to state government; setting salaries of 
  1.3             administrative law judges; amending Minnesota Statutes 
  1.4             1994, sections 15A.081, subdivision 1; 15A.083, 
  1.5             subdivisions 6a, 7, and by adding a subdivision; and 
  1.6             43A.18, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 15A.081, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [SALARY RANGES.] The governor shall set the 
  1.11  salary rate within the ranges listed below for positions 
  1.12  specified in this subdivision, upon approval of the legislative 
  1.13  commission on employee relations and the legislature as provided 
  1.14  by section 3.855: 
  1.15                            Salary Range 
  1.16  $57,500-$78,500 
  1.17     Commissioner of finance; 
  1.18     Commissioner of education; 
  1.19     Commissioner of transportation; 
  1.20     Commissioner of human services; 
  1.21     Commissioner of revenue; 
  1.22     Commissioner of public safety; 
  1.23     Executive director, state board of investment; 
  1.24  $50,000-$67,500 
  1.25     Commissioner of administration; 
  1.26     Commissioner of agriculture; 
  2.1      Commissioner of commerce; 
  2.2      Commissioner of corrections; 
  2.3      Commissioner of economic security; 
  2.4      Commissioner of employee relations; 
  2.5      Commissioner of health; 
  2.6      Commissioner of labor and industry; 
  2.7      Commissioner of natural resources; 
  2.8      Commissioner of trade and economic development;

  2.27     Sec. 2.  Minnesota Statutes 1994, section 15A.083, 
  2.28  subdivision 6a, is amended to read: 
  2.29     Subd. 6a.  [ADMINISTRATIVE LAW JUDGE; MAXIMUM SALARY 
  2.30  JUDGES.] The maximum salary Salaries of an administrative law 
  2.31  judge judges in the classified service employed by the office of 
  2.32  administrative hearings is are 90 percent of the salary of 
  2.33  district court judges as set under section 15A.082, subdivision 
  2.34  3.  Salaries of administrative law judge supervisors employed by 
  2.35  the office of administrative hearings are 95 percent of the 
  2.36  salary of district court judges as set under section 15A.082, 
  3.1   subdivision 3. 
  3.2      Sec. 3.  Minnesota Statutes 1994, section 15A.083, is 
  3.3   amended by adding a subdivision to read: 
  3.4      Subd. 6b.  [CHIEF ADMINISTRATIVE LAW JUDGE AND ASSISTANT 
  3.5   CHIEF ADMINISTRATIVE LAW JUDGE.] The salary of the chief 
  3.6   administrative law judge is the same as the salary of district 
  3.7   court judges as set under section 15A.082, subdivision 3.  The 
  3.8   salary of the assistant chief administrative law judge is 95 
  3.9   percent of the salary of district court judges as set under 
  3.10  section 15A.082, subdivision 3. 
  3.11     Sec. 4.  Minnesota Statutes 1994, section 15A.083, 
  3.12  subdivision 7, is amended to read: 
  3.13     Subd. 7.  [WORKERS' COMPENSATION COURT OF APPEALS AND 
  3.14  COMPENSATION JUDGES.] Salaries of judges of the workers' 
  3.15  compensation court of appeals are the same as the salary for 
  3.16  district judges as set under section 15A.082, subdivision 3.  
  3.17  Salaries of compensation judges employed by the office of 
  3.18  administrative hearings are 90 percent of the salary of district 
  3.19  court judges as set under section 15A.082, subdivision 3.  
  3.20  Salaries of workers' compensation settlement judges at the 
  3.21  department of labor and industry are 75 percent of the salary of 
  3.22  district court judges as set under section 15A.082, subdivision 
  3.23  3.  The chief workers' compensation settlement judge at the 
  3.24  department of labor and industry may be paid an annual salary 
  3.25  that is up to five percent greater than the salary of workers' 
  3.26  compensation settlement judges at the department of labor and 
  3.27  industry. 
  3.28     Sec. 5.  Minnesota Statutes 1994, section 43A.18, 
  3.29  subdivision 4, is amended to read: 
  3.30     Subd. 4.  [PLANS NOT ESTABLISHED BUT APPROVED BY 
  3.31  COMMISSIONER.] (a) Notwithstanding any other law to the 
  3.32  contrary, terms and conditions of employment for employees 
  3.33  listed in this subdivision must be set by appointing authorities 
  3.34  within the limits of compensation plans that have been approved 
  3.35  by the commissioner before becoming effective.  Compensation 
  3.36  plans established under paragraphs paragraph (c) and (d), must 
  4.1   be reviewed and approved, modified, or rejected by the 
  4.2   legislature and the legislative commission on employee relations 
  4.3   under section 3.855, subdivision 2, before becoming effective. 
  4.4      (b) Total compensation for employees who are not covered by 
  4.5   a collective bargaining agreement in the offices of the 
  4.6   governor, lieutenant governor, attorney general, secretary of 
  4.7   state, state auditor, and state treasurer must be determined by 
  4.8   the governor, lieutenant governor, attorney general, secretary 
  4.9   of state, state auditor, and state treasurer, respectively.  
  4.10     (c) Total compensation for classified administrative law 
  4.11  judges in the office of administrative hearings must be 
  4.12  determined by the chief administrative law judge.  
  4.13     (d) Total compensation for unclassified positions not 
  4.14  covered by a collective bargaining agreement in the higher 
  4.15  education coordinating board must be determined by the higher 
  4.16  education coordinating board. 
  4.17     Sec. 6.  [EFFECTIVE DATE.] 
  4.18     Sections 1 to 5 are effective January 1, 1995.
