  1.1                          A bill for an act 
  1.2             relating to administration; changing provisions 
  1.3             governing the use of professional and technical 
  1.4             services; amending Minnesota Statutes 1996, section 
  1.5             16B.167. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 16B.167, is 
  1.8   amended to read: 
  1.9      16B.167 [EMPLOYEE SKILLS INVENTORY.] 
  1.10     The commissioners of employee relations and administration 
  1.11  shall develop a list of skills that state agencies commonly seek 
  1.12  from professional or technical service contracts, in 
  1.13  consultation with exclusive representatives of state employees. 
  1.14     Before an agency may seek approval of a professional or 
  1.15  technical services contract valued in excess of $25,000, it must 
  1.16  certify to the commissioner that it has publicized the contract 
  1.17  by posting notice at appropriate worksites within agencies and 
  1.18  has made reasonable efforts to determine that no state employee, 
  1.19  including an employee outside the contracting agency, is able 
  1.20  and available to perform the services called for by the contract.
  1.21  When possible this posting must be done electronically. 
  1.22     For purposes of sections 16B.167 to 16B.175, "agency" 
  1.23  includes the Minnesota state colleges and universities. 
  1.24     Sec. 2.  [EFFECTIVE DATE.] 
  1.25     Section 1 is effective the day following final enactment.
