  1.1                          A bill for an act 
  1.2             relating to crime; prohibiting fleeing a peace officer 
  1.3             by means of a motor vehicle in a manner that makes it 
  1.4             imminently dangerous to others; prescribing penalties; 
  1.5             amending Minnesota Statutes 1994, section 609.487, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 609.487, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 3a.  [FLEEING AN OFFICER; ENDANGERMENT OF 
  1.11  OTHERS.] Whoever by means of a motor vehicle flees or attempts 
  1.12  to flee a peace officer acting in the lawful discharge of an 
  1.13  official duty is guilty of a felony if: 
  1.14     (1) the perpetrator knows or should reasonably know the 
  1.15  pursuer to be a peace officer; 
  1.16     (2) the perpetrator ignores all attempts by the peace 
  1.17  officer to signal the perpetrator to stop the fleeing motor 
  1.18  vehicle; and 
  1.19     (3) the surrounding circumstances are such that the fleeing 
  1.20  motor vehicle is imminently dangerous to others. 
  1.21     The offender may be sentenced to imprisonment for not more 
  1.22  than one year and one day or to payment of a fine of not more 
  1.23  than $3,000, or both.
