  1.1                          A bill for an act
  1.2             relating to education; removing certain state 
  1.3             education mandates unless they are fully funded; 
  1.4             amending Minnesota Statutes 1994, sections 124.225, 
  1.5             subdivision 7f; 124A.225, subdivision 1; and 124A.29 
  1.6             subdivisions 1 and 2; repealing Minnesota Statutes 
  1.7             1994, section 124A.225, subdivisions 2, 3, 4, 5, and 6.
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 124.225, 
  1.10  subdivision 7f, is amended to read: 
  1.11     Subd. 7f.  [RESERVED REVENUE FOR TRANSPORTATION SAFETY.] A 
  1.12  district shall reserve an amount equal to the lesser of:  (1) 
  1.13  the amount separately appropriated for transportation safety; or 
  1.14  (2) the greater of $1,000 or one percent of the sum of the 
  1.15  district's regular transportation revenue according to 
  1.16  subdivision 7d, paragraph (a), and nonregular transportation 
  1.17  revenue according to subdivision 7d, paragraph (b), for that 
  1.18  school year to provide student transportation safety programs 
  1.19  under section 123.799. 
  1.20     Sec. 2.  Minnesota Statutes 1994, section 124A.225, 
  1.21  subdivision 1, is amended to read: 
  1.22     Subdivision 1.  [REVENUE.] Of a district's general 
  1.23  education revenue an amount equal to the sum of the number of 
  1.24  elementary pupils in average daily membership defined in section 
  1.25  124.17, subdivision 1, clause (f), and one-half of the number of 
  1.26  kindergarten pupils in average daily membership as defined in 
  2.1   section 124.17, subdivision 1, clause (e), times .03 for fiscal 
  2.2   year 1994 and .06 for fiscal year 1995 and thereafter times the 
  2.3   formula allowance must be reserved according to this section 
  2.4   used to reduce elementary class sizes in a manner according to a 
  2.5   plan adopted by the local school board. 
  2.6      Sec. 3.  Minnesota Statutes 1994, section 124A.29, 
  2.7   subdivision 1, is amended to read: 
  2.8      Subdivision 1.  [STAFF DEVELOPMENT AND PARENTAL INVOLVEMENT 
  2.9   REVENUE.] (a) Of a district's basic revenue under section 
  2.10  124A.22, subdivision 2, A district must reserve revenue for 
  2.11  staff development equal to the lesser of:  (1) the amount 
  2.12  separately appropriated for that purpose; or (2) an amount equal 
  2.13  to one percent in fiscal year 1994, two percent in fiscal year 
  2.14  1995, and 2.5 percent in fiscal year 1996 and thereafter times 
  2.15  the formula allowance times the number of actual pupil units 
  2.16  shall be reserved and may be used only for in-service education 
  2.17  for programs under section 126.77, subdivision 2, or for staff 
  2.18  development plans, including plans for challenging instructional 
  2.19  activities and experiences under section 126.70.  Districts may 
  2.20  expend an additional amount of basic revenue for staff 
  2.21  development based on their needs.  The school board shall 
  2.22  initially allocate 50 percent of the revenue to each school site 
  2.23  in the district on a per teacher basis, which shall be retained 
  2.24  by the school site until used.  The board may retain 25 percent 
  2.25  to be used for district wide staff development efforts.  The 
  2.26  remaining 25 percent of the revenue shall be used to make grants 
  2.27  to school sites that demonstrate exemplary use of allocated 
  2.28  staff development revenue.  A grant may be used for any purpose 
  2.29  authorized under section 126.70 or 126.77, subdivision 2, and 
  2.30  determined by the site decision-making team.  The site 
  2.31  decision-making team must demonstrate to the school board the 
  2.32  extent to which staff at the site have met the outcomes of the 
  2.33  program.  The board may withhold a portion of initial allocation 
  2.34  of revenue if the staff development outcomes are not being met. 
  2.35     (b) Of a district's basic revenue under section 124A.22, 
  2.36  subdivision 2, A school district must reserve revenue for 
  3.1   parental involvement equal to the lesser of:  (1) the amount 
  3.2   separately appropriated for that purpose; or (2) an amount equal 
  3.3   to $5 times the number of actual pupil units must be reserved 
  3.4   and may be used only to provide parental involvement programs 
  3.5   that implement section 126.69.  Parental involvement programs 
  3.6   may include career teacher programs, programs promoting parental 
  3.7   involvement in the PER process, coordination of volunteer 
  3.8   services, participation in developing, implementing, or 
  3.9   evaluating school desegregation/integration plans, and programs 
  3.10  designed to encourage community involvement. 
  3.11     Sec. 4.  Minnesota Statutes 1994, section 124A.29, 
  3.12  subdivision 2, is amended to read: 
  3.13     Subd. 2.  [CAREER TEACHER STAFF DEVELOPMENT.] Of a 
  3.14  district's basic revenue under section 124A.22, subdivision 2, A 
  3.15  school district must reserve revenue for career teacher staff 
  3.16  development.  The amount of revenue reserved equals the lesser 
  3.17  of:  (1) the amount separately appropriated for that program; or 
  3.18  (2) an amount equal to $5 times the number of actual pupil units 
  3.19  shall be reserved by a district operating a career teacher 
  3.20  program according to sections 125.701 to 125.705.  The revenue 
  3.21  may be used only to provide staff development for the career 
  3.22  teacher program. 
  3.23     Sec. 5.  [REPEALER.] 
  3.24     Minnesota Statutes 1994, section 124A.225, subdivisions 2, 
  3.25  3, 4, 5, and 6, are repealed. 
  3.26     Sec. 6.  [EFFECTIVE DATE.] 
  3.27     Sections 1 to 5 are effective July 1, 1995.
