  1.1                          A bill for an act 
  1.2             relating to Washington county; providing that certain 
  1.3             personal information on property taxpayers may be kept 
  1.4             from certain lists at the taxpayer's request. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [TAXPAYER'S PERSONAL INFORMATION; DISCLOSURE.] 
  1.7      (a) Notwithstanding Minnesota Statutes, chapter 13, or 
  1.8   other law, an owner of real property in Washington county that 
  1.9   is subject to property taxation must be informed in a clear and 
  1.10  conspicuous manner on a form sent to property taxpayers that the 
  1.11  applicant's personal information may be disclosed to any person 
  1.12  who makes a request for the personal information and that, 
  1.13  except for uses permitted by United States Code, title 18, 
  1.14  section 2721, clause (b), the applicant may prohibit disclosure 
  1.15  of the personal information by so indicating on the form. 
  1.16     (b) An owner of real property in Washington county that is 
  1.17  subject to property taxation also must be informed in a clear 
  1.18  and conspicuous manner on the form that the property taxpayer's 
  1.19  personal information may be used, rented, or sold solely for 
  1.20  bulk distribution by organizations for business purposes, 
  1.21  including surveys, marketing, or solicitation.  The county shall 
  1.22  implement methods and procedures that enable the property 
  1.23  taxpayers to request that bulk surveys, marketing, or 
  1.24  solicitation not be directed to the property taxpayer.  If the 
  1.25  property taxpayer so requests, the county shall implement the 
  2.1   request in a timely manner and the personal information may not 
  2.2   be so used. 
  2.3      Sec. 2.  [LOCAL APPROVAL REQUIRED.] 
  2.4      Section 1 is effective the day after the chief clerical 
  2.5   officer of Washington county complies with Minnesota Statutes, 
  2.6   section 645.021, subdivision 3.
