A bill for an act
relating to health; establishing a Health Care Access Fund Oversight
Commission; proposing coding for new law in Minnesota Statutes, chapter 62J.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

The Health Care Access Fund Oversight
Commission shall:

(1) develop criteria for acceptable uses of the health care access fund that maintain
the integrity of the health care access fund as a funding source to expand access to health
care services for low-income Minnesotans without replacing general fund appropriations
for existing programs; and

(2) review all legislative proposals for new uses of the health care access fund and
make recommendations to the legislature as to whether the proposal meets the criteria
developed for acceptable uses.

The Health Care Access Fund Oversight Commission
consists of:

(1) three health care providers appointed by the governor, who represent hospitals,
physicians, prescription drug wholesalers and pharmacists, dentists, or optometrists, with
no more than one member representing a specific provider group;

(2) two advocates for MinnesotaCare recipients appointed by the governor;

new text begin
(3) two members of the house of representatives appointed under the rules of the
house of representatives and two members of the senate appointed under the rules of the
senate, with one member of each body being from the majority party and one member of
each body being from the minority party; and

(4) the commissioner of human services, or the commissioner's designee.

The commission shall meet at least twice annually.
The commissioner of human services shall provide staff support for the commission.
The commission is governed by section 15.059, except that members shall receive
reimbursement only for expenses and the commission shall not expire.
