  1.1                          A bill for an act 
  1.2             relating to civil actions; limiting the liability of 
  1.3             grocery stores and delicatessens as food donors to the 
  1.4             elderly or needy; amending Minnesota Statutes 1994, 
  1.5             section 604A.10, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 604A.10, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [DEFINITIONS.] (a) For the purposes of this 
  1.10  section, the following terms have the meanings given them. 
  1.11     (b) "Distressed food" means, in addition to the definition 
  1.12  in section 31.495, certain perishable foods, as defined in 
  1.13  section 28A.03, that may not be readily marketable due to 
  1.14  appearance, freshness, grade, surplus, or other considerations 
  1.15  and are not suspect of having been rendered unsafe or unsuitable 
  1.16  for food use and are adequately labeled.  
  1.17     (c) "Food bank" means a surplus food collection and 
  1.18  distribution system operated and established to assist in 
  1.19  bringing donated food to nonprofit charitable organizations and 
  1.20  individuals for the purpose of reducing hunger and meeting 
  1.21  nutritional needs. 
  1.22     (d) "Food facility" means: 
  1.23     (1) a restaurant, food establishment, grocery store, 
  1.24  delicatessen, vehicle, vending machine, produce stand, temporary 
  1.25  food facility, satellite food distribution facility, stationary 
  2.1   mobile food preparation unit, or mobile food preparation unit; 
  2.2      (2) a place used in conjunction with the operations 
  2.3   described in clause (1), including, but not limited to, storage 
  2.4   facilities for food-related utensils, equipment, and materials; 
  2.5   or 
  2.6      (3) a farmers' market. 
  2.7      (e) "Nonprofit charitable organization" means an 
  2.8   organization that is incorporated under the Minnesota nonprofit 
  2.9   corporation act and is operating for charitable purposes. 
  2.10     Sec. 2.  [EFFECTIVE DATE.] 
  2.11     Section 1 is effective the day following final enactment.
