  1.1                          A bill for an act
  1.2             relating to highways; requiring the commissioner of 
  1.3             transportation to transfer certain easements to the 
  1.4             city of Faribault; authorizing the commissioner of 
  1.5             transportation to transfer certain excess property. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [COMMISSIONER OF TRANSPORTATION; TRANSFER OF 
  1.8   EASEMENTS.] 
  1.9      Notwithstanding any law to the contrary, the commissioner 
  1.10  of transportation, after reaching agreement with the city on the 
  1.11  terms and conditions of the transfer, but not later than 
  1.12  December 31, 1997, shall transfer to the city of Faribault all 
  1.13  easements within the city that the commissioner acquired to 
  1.14  relocate marked trunk highway No. 218 within the city but that 
  1.15  are no longer needed for that purpose. 
  1.16     Sec. 2.  [PROPERTY TRANSFER.] 
  1.17     Subdivision 1.  [TRANSFER AUTHORIZED.] Notwithstanding 
  1.18  Minnesota Statutes, section 161.44, the commissioner of 
  1.19  transportation may convey the excess property described in 
  1.20  subdivision 2 to a purchaser who is not the original owner. 
  1.21     Subd. 2.  [PROPERTY DESCRIBED.] The property to be conveyed 
  1.22  under subdivision 1 is described as follows: 
  1.23     TRACT A.  That part of lots 5, 6 and 7, block 3, Cedar Lake 
  1.24     park addition to Minneapolis, according to the plat thereof 
  1.25     on file and of record in the office of the county recorder 
  2.1      in and for Hennepin county, Minnesota, lying easterly of a 
  2.2      line drawn at right angles to the north line of said block 
  2.3      3, from a point thereon distant 306 feet west, along said 
  2.4      north line, from the northeast corner of said block 3; 
  2.5   which lies westerly of a line run parallel with and distant 30 
  2.6   feet northwesterly, westerly and southwesterly of line 1 
  2.7   described below: 
  2.8      LINE 1.  Commencing at the east quarter corner of section 
  2.9      29, township 29 north, range 24 west; thence run westerly 
  2.10     on an azimuth of 269 degrees 32 minutes 03 seconds along 
  2.11     the east and west quarter line of said section 29 for 
  2.12     110.64 feet; thence on an azimuth of 186 degrees 56 minutes 
  2.13     39 seconds, 385.74 feet; thence on an azimuth of 298 
  2.14     degrees 31 minutes 31 seconds, 539.48 feet; thence on an 
  2.15     azimuth of 204 degrees 25 minutes 00 seconds, 144.4 feet; 
  2.16     thence on an azimuth of 249 degrees 07 minutes 52 seconds, 
  2.17     165.81 feet to the point of beginning of line 1 to be 
  2.18     described; thence on an azimuth of 69 degrees 07 minutes 52 
  2.19     seconds, 100 feet; thence deflect to the left on a 
  2.20     tangential curve having a radius of 160 feet and a delta 
  2.21     angle of 44 degrees 42 minutes 52 seconds for 124.87 feet; 
  2.22     thence on an azimuth of 24 degrees 25 minutes 00 seconds, 
  2.23     0.53 feet; thence deflect to the left on a tangential curve 
  2.24     having a radius of 61 feet and a delta angle of 96 degrees 
  2.25     36 minutes 29 seconds for 102.85 feet to a point of 
  2.26     compound curvature; thence deflect to the left on a 
  2.27     tangential curve having a radius of 1277.97 feet and a 
  2.28     delta angle of 16 degrees 49 minutes 46 seconds for 375.38 
  2.29     feet and there terminating. 
  2.30     Sec. 3.  [EFFECTIVE DATE.] 
  2.31     Section 1 is effective on approval by the Faribault city 
  2.32  council and compliance with Minnesota Statutes, section 645.021, 
  2.33  subdivision 3.
