A bill for an act
relating to insurance; permitting service cooperatives
to provide group health coverage to private employers;
proposing coding for new law in Minnesota Statutes,
chapter 123A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A service cooperative organized under section 123A.21 may
create and manage one or more group health coverage pools for
private employers. A pool may be either fully insured or
self-insured. The service cooperative must not cover public
employers and private employers in the same pool. The service
cooperative and the pool must comply with all state and federal
laws that apply to the type of pool involved, including section
62L.045 and chapter 62H. A pool authorized under this section
must permit sale of its products by insurance producers, as
defined in section 60K.31, who are licensed to sell health
insurance in this state.
