  1.1                          A bill for an act 
  1.2             relating to data practices; clarifying the authority 
  1.3             of the commissioner of administration to issue 
  1.4             opinions; clarifying the treatment of data submitted 
  1.5             to the commissioner of administration; removing a 
  1.6             requirement that government entities pay for opinions; 
  1.7             eliminating the sunset repealer for the commissioner's 
  1.8             data practices opinion authority; amending Minnesota 
  1.9             Statutes 1994, section 13.072, by adding a 
  1.10            subdivision; and Laws 1993, chapter 192, section 110; 
  1.11            repealing Minnesota Statutes 1994, section 13.072, 
  1.12            subdivision 3. 
  1.13  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.14     Section 1.  Minnesota Statutes 1994, section 13.072, is 
  1.15  amended by adding a subdivision to read: 
  1.16     Subd. 4.  [DATA SUBMITTED TO COMMISSIONER.] Government data 
  1.17  submitted to the commissioner by a state agency, political 
  1.18  subdivision, or statewide system for the purpose of requesting 
  1.19  or responding to a citizen's request for an opinion shall have 
  1.20  the same classification when held by the commissioner as it had 
  1.21  when held by the state agency, political subdivision, or 
  1.22  statewide system.  Government data submitted to the commissioner 
  1.23  by other persons requesting opinions shall have the same 
  1.24  classification that copies of the data would have in the 
  1.25  government entity or comparable data would have in the 
  1.26  government entity about whose data the person is requesting an 
  1.27  opinion.  If the nature of the opinion is such that the release 
  1.28  of the opinion would reveal not public data, the commissioner is 
  1.29  authorized to issue opinion using pseudonyms for individuals. 
  2.1      Sec. 2.  Laws 1993, chapter 192, section 110, is amended to 
  2.2   read: 
  2.3      Sec. 110.  [REPEALER.] 
  2.4      (a) Minnesota Statutes 1992, section 309.502, is repealed. 
  2.5      (b) Minnesota Statutes 1992, sections 16A.095, subdivision 
  2.6   3; 16A.123; 16A.128; 16A.1281; 16A.35; 16A.45, subdivisions 2 
  2.7   and 3; 16A.80; and 290A.24, are repealed. 
  2.8      (c) Minnesota Statutes 1992, section 13.072, is repealed 
  2.9   effective August 1,1995. 
  2.10     Sec. 3.  [REPEALER.] 
  2.11     Minnesota Statutes 1994, section 13.072, subdivision 3, is 
  2.12  repealed. 
  2.13     Sec. 4.  [EFFECTIVE DATE.] 
  2.14     Sections 1 to 3 are effective the day following final 
  2.15  enactment.
