  1.1                          A bill for an act 
  1.2             relating to public lands; requiring the transfer of 
  1.3             land owned by Hennepin county to the city of Eden 
  1.4             Prairie; appropriating money for the sale of the land. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [TRANSFER OF LAND IN HENNEPIN COUNTY.] 
  1.7      Subdivision 1.  [CONVEYANCE.] Upon receipt of $......., 
  1.8   Hennepin county shall convey to the city of Eden Prairie the 
  1.9   land that is described in subdivision 3. 
  1.10     Subd. 2.  [FORM.] (a) The conveyance must be in a form 
  1.11  approved by the attorney general and provide that ownership of 
  1.12  the property will transfer to the state if the city of Eden 
  1.13  Prairie stops using the property for park and open space 
  1.14  purposes. 
  1.15     (b) The conveyance is subject to a conservation easement in 
  1.16  favor of and approved by the Minnesota land trust. 
  1.17     Subd. 3.  [DESCRIPTION.] The land to be conveyed is located 
  1.18  in Hennepin county and is described as: 
  1.19     (1) that part of the Northeast Quarter of Section 4, 
  1.20  Township 116 North, Range 22 West, described as follows, 
  1.21  to-wit:  Commencing at the east one-quarter corner of said 
  1.22  Section; thence West along the south line of said quarter 
  1.23  section to a point which, measured along said line, is 1201 feet 
  1.24  East of the point of intersection of said line with the 
  1.25  southerly right-of-way line of the Chicago, Milwaukee and St. 
  2.1   Paul Railway; thence at right angles North a distance of 235 
  2.2   feet; thence South 70 degrees West 134.7 feet; thence South 86 
  2.3   degrees, 50 minutes West 147 feet; thence North 55 degrees, 50 
  2.4   minutes West 94.5 feet; thence North 21 degrees, 50 minutes West 
  2.5   168.5 feet, more or less, to the northerly line of the 
  2.6   right-of-way, now abandoned, of Chicago, Milwaukee & St. Paul 
  2.7   Railway Company; thence northeasterly along the northerly line 
  2.8   of said abandoned right-of-way to the intersection of said line 
  2.9   with the center line of the county road; thence North along the 
  2.10  center line of said road to the intersection of said line with 
  2.11  the south line of the present right-of-way of the Chicago, 
  2.12  Milwaukee & St. Paul Railway; thence northeasterly along said 
  2.13  right-of-way line to its intersection with the east line of said 
  2.14  Section 4; thence South along the east line of said Section to 
  2.15  the point of beginning.  Subject to the right-of-way across said 
  2.16  premises, owned and occupied by the Minneapolis and St. Louis 
  2.17  Railroad Company; 
  2.18     (2) those portions of the Northeast Quarter of the 
  2.19  Northeast Quarter and of the Southeast Quarter of the Northeast 
  2.20  Quarter all in Section 4, Township 116 North, Range 22 West, 
  2.21  lying westerly of the center line of Indian Chief road, formerly 
  2.22  county road, which lies between the southeasterly right-of-way 
  2.23  line of the Twin Cities and Western Railroad, formerly the 
  2.24  Chicago, Milwaukee, St. Paul and Pacific Railroad Company, and 
  2.25  the northerly right-of-way line of the abandoned Chicago, 
  2.26  Milwaukee and St. Paul Railway Company; and 
  2.27     (3) that part of the Southwest Quarter of the Northeast 
  2.28  Quarter of Section 4, Township 116 North, Range 22 West, 
  2.29  described as commencing at the east quarter corner of said 
  2.30  Section 4; thence on an assumed bearing of West along the south 
  2.31  line of said Northeast Quarter to a point distant 1201 feet 
  2.32  easterly from its intersection with the southeasterly 
  2.33  right-of-way line of the Twin Cities and Western Railroad, 
  2.34  formerly the Chicago, Milwaukee, St. Paul and Pacific Railroad 
  2.35  Company; thence on a bearing of North, 235 feet; thence South 70 
  2.36  degrees West, 134.7 feet; thence South 86 degrees 50 minutes 
  3.1   West, 147 feet; thence North 55 degrees 50 minutes West, 94.5 
  3.2   feet; thence North 21 degrees 50 minutes West, 101.78 feet; 
  3.3   thence South 63 degrees 18 minutes West, 11.96 feet; thence 
  3.4   southwesterly 580.07 feet along a tangential curve to the right 
  3.5   having a radius of 1910.08 feet and a central angle of 17 
  3.6   degrees 24 minutes to a point hereinafter referred to as Point 
  3.7   "A"; thence South 80 degrees 42 minutes West, 8.5 feet, more or 
  3.8   less, to said southeasterly right-of-way line, being the actual 
  3.9   point of beginning; thence North 80 degrees 42 minutes East to 
  3.10  said Point "A"; thence northeasterly 580.07 feet along said 
  3.11  curve having a radius of 1910.08 feet; thence North 63 degrees 
  3.12  18 minutes East 11.96 feet; thence North 21 degrees 50 minutes 
  3.13  West 50.18 feet, more or less, to the northerly right-of-way 
  3.14  line of the abandoned Chicago, Milwaukee and St. Paul Railway 
  3.15  Company; thence northeasterly along said northerly right-of-way 
  3.16  line 267.8 feet, more or less, to its intersection with said 
  3.17  southeasterly right-of-way line of said Twin Cities and Western 
  3.18  Railroad; thence northwesterly along said southeasterly 
  3.19  right-of-way line 119 feet, more or less, to an angle point in 
  3.20  said southeasterly right-of-way line; thence southwesterly along 
  3.21  said southeasterly right-of-way line 408.13 feet to an angle 
  3.22  point in said southeasterly right-of-way line; thence 
  3.23  northwesterly along said southeasterly right-of-way line 60 feet 
  3.24  to an angle point in said southeasterly right-of-way line; 
  3.25  thence southwesterly along said southeasterly right-of-way line 
  3.26  to the point of beginning.  
  3.27     Sec. 2.  [APPROPRIATION.] 
  3.28     $....... is appropriated from the general fund to the 
  3.29  commissioner of natural resources for a grant to the city of 
  3.30  Eden Prairie to acquire the lands described in section 1.
