  1.9             subdivisions 1, 3; repealing Minnesota Statutes 2002, 
  1.10            section 119A.01, subdivision 1. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 2002, section 15.01, is 
  1.13  amended to read: 
  1.14     15.01 [DEPARTMENTS OF THE STATE.] 
  1.15     The following agencies are designated as the departments of 
  1.16  the state government:  the department of administration; the 
  1.17  department of agriculture; the department of commerce; the 
  1.18  department of corrections; the department of children, families, 
  1.19  and learning education; the department of economic security; the 
  1.20  department of trade and economic development; the department of 
  1.21  finance; the department of health; the department of human 
  1.22  rights; the department of labor and industry; the department of 
  1.23  military affairs; the department of natural resources; the 
  1.24  department of employee relations; the department of public 
  1.25  safety; the department of human services; the department of 
  1.26  revenue; the department of transportation; the department of 
  1.27  veterans affairs; and their successor departments. 
  1.28     Sec. 2.  Minnesota Statutes 2002, section 119A.01, 
  2.1   subdivision 2, is amended to read: 
  2.2      Subd. 2.  [ESTABLISHMENT.] The department of children, 
  2.3   families, and learning education is established. 
  2.4      Sec. 3.  Minnesota Statutes 2002, section 119A.02, 
  2.5   subdivision 2, is amended to read: 
  2.6      Subd. 2.  [COMMISSIONER.] "Commissioner" means the 
  2.7   commissioner of children, families, and learning education. 
  2.8      Sec. 4.  Minnesota Statutes 2002, section 119A.02, 
  2.9   subdivision 3, is amended to read: 
  2.10     Subd. 3.  [DEPARTMENT.] "Department" means the department 
  2.11  of children, families, and learning education. 
  2.12     Sec. 5.  Minnesota Statutes 2002, section 119B.011, 
  2.13  subdivision 8, is amended to read: 
  2.14     Subd. 8.  [COMMISSIONER.] "Commissioner" means the 
  2.15  commissioner of children, families, and learning education. 
  2.16     Sec. 6.  Minnesota Statutes 2002, section 119B.011, 
  2.17  subdivision 10, is amended to read: 
  2.18     Subd. 10.  [DEPARTMENT.] "Department" means the department 
  2.19  of children, families, and learning education. 
  2.20     Sec. 7.  Minnesota Statutes 2002, section 120A.02, is 
  2.21  amended to read: 
  2.22     120A.02 [DEPARTMENT OF CHILDREN, FAMILIES, AND LEARNING 
  2.23  EDUCATION.] 
  2.24     The department of children, families, and learning 
  2.25  education shall carry out the provisions of chapters 120A to 
  2.26  129C and other related education provisions under law. 
  2.27     Sec. 8.  Minnesota Statutes 2002, section 120A.05, 
  2.28  subdivision 4, is amended to read: 
  2.29     Subd. 4.  [COMMISSIONER.] "Commissioner" means the 
  2.30  commissioner of children, families, and learning education. 
  2.31     Sec. 9.  Minnesota Statutes 2002, section 120A.05, 
  2.32  subdivision 7, is amended to read: 
  2.33     Subd. 7.  [DEPARTMENT.] "Department" means the department 
  2.34  of children, families, and learning education. 
  2.35     Sec. 10.  Minnesota Statutes 2002, section 127A.05, 
  2.36  subdivision 1, is amended to read: 
  3.1      Subdivision 1.  [APPOINTMENT AND DUTIES.] The department 
  3.2   shall be under the administrative control of the commissioner of 
  3.3   children, families, and learning education which office is 
  3.4   established.  The governor shall appoint the commissioner under 
  3.5   the provisions of section 15.06.  
  3.6      The commissioner shall be a person who possesses 
  3.7   educational attainment and breadth of experience in the 
  3.8   administration of public education and of the finances 
  3.9   pertaining thereto commensurate with the spirit and intent of 
  3.10  this code.  Notwithstanding any other law to the contrary, the 
  3.11  commissioner may appoint two deputy commissioners who shall 
  3.12  serve in the unclassified service.  The commissioner shall also 
  3.13  appoint other employees as may be necessary for the organization 
  3.14  of the department.  The commissioner shall perform such duties 
  3.15  as the law and rules may provide and be held responsible for the 
  3.16  efficient administration and discipline of the department.  The 
  3.17  commissioner is charged with the execution of powers and duties 
  3.18  to promote public education in the state and to safeguard the 
  3.19  finances pertaining thereto. 
  3.20     Sec. 11.  Minnesota Statutes 2002, section 127A.05, 
  3.21  subdivision 3, is amended to read: 
  3.22     Subd. 3.  [GENERAL SUPERVISION OVER PUBLIC SCHOOLS AND 
  3.23  EDUCATIONAL AGENCIES.] The commissioner of children, families, 
  3.24  and learning education shall adopt goals for and exercise 
  3.25  general supervision over public schools and public educational 
  3.26  agencies in the state, classify and standardize public 
  3.27  elementary and secondary schools, and prepare for them outlines 
  3.28  and suggested courses of study.  The commissioner shall develop 
  3.29  a plan to attain the adopted goals.  The commissioner may 
  3.30  recognize educational accrediting agencies for the sole purposes 
  3.31  of sections 120A.22, 120A.24, and 120A.26. 
  3.32     Sec. 12.  [REVISOR INSTRUCTION.] 
  3.33     (a) In Minnesota Statutes, the revisor shall renumber 
  3.34  section 119A.02, subdivision 2, as 120A.02, paragraph (a), and 
  3.35  section 120A.02 as 120A.02, paragraph (b). 
  3.36     (b) In Minnesota Statutes and Minnesota Rules, the revisor 
  4.1   shall change the term "children, families, and learning" to 
  4.2   "education." 
  4.3      Sec. 13.  [REPEALER.] 
  4.4      Minnesota Statutes 2002, section 119A.01, subdivision 1, is 
  4.5   repealed.
