A bill for an act
relating to education finance; creating an alternative
to out-of-school suspension; authorizing a funding
mechanism; appropriating money; proposing coding for
new law in Minnesota Statutes, chapter 121A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Notwithstanding
any law to the contrary and in accordance with sections 121A.40
to 121A.56, after a school administration notifies a pupil of
the grounds for suspension, the school administration may,
instead of imposing the suspension, do one or more of the
following:

(1) strongly encourage a parent or guardian of the pupil to
attend school with the pupil for one day;

(2) assign the pupil to attend school on Saturday as
supervised by the principal or the principal's designee; and

(3) petition the juvenile court that the student is in need
of services under chapter 260C.

new text begin A school district that offers an
alternative to out-of-school suspension is eligible for aid
equal to the lesser of the district's actual costs for the
alternative program described in subdivision 1 or $54 per hour.

This section is effective July 1, 2005,
for revenue for fiscal year 2006.

commissioner of education for payment of alternative school
