  1.1                          A bill for an act
  1.2             relating to crime; providing a mandatory minimum 
  1.3             sentence for persons who use or attempt to use deadly 
  1.4             force against a peace officer who is engaged in 
  1.5             official duties; amending Minnesota Statutes 1996, 
  1.6             section 609.221. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 609.221, is 
  1.9   amended to read: 
  1.10     609.221 [ASSAULT IN THE FIRST DEGREE.] 
  1.11     Subdivision 1.  [GREAT BODILY HARM.] Whoever assaults 
  1.12  another and inflicts great bodily harm may be sentenced to 
  1.13  imprisonment for not more than 20 years or to payment of a fine 
  1.14  of not more than $30,000, or both.  
  1.15     Subd. 2.  [USE OF DEADLY FORCE AGAINST PEACE OFFICER.] (a) 
  1.16  Whoever assaults a peace officer by using or attempting to use 
  1.17  deadly force against the officer while the officer is engaged in 
  1.18  official duties, shall be sentenced to imprisonment for not less 
  1.19  than ten years nor more than 20 years and, in addition, may be 
  1.20  sentenced to payment of a fine of not more than $30,000. 
  1.21     (b) As used in this subdivision: 
  1.22     (1) "deadly force" has the meaning given in section 
  1.23  609.066, subdivision 1; and 
  1.24     (2) "peace officer" has the meaning given in section 
  1.25  626.84, subdivision 1.  
  1.26     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective August 1, 1997, and applies to 
  2.2   crimes committed on or after that date.
