  1.1                          A bill for an act 
  1.2             relating to counties; limiting salaries, other 
  1.3             compensation and conditions of service of county 
  1.4             commissioners; amending Minnesota Statutes 1994, 
  1.5             section 375.055, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 375.055, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [FIXED BY COUNTY BOARD.] (a) The county 
  1.10  commissioners in all counties, except Hennepin and Ramsey, shall 
  1.11  receive as compensation for services rendered by them for their 
  1.12  respective counties, annual salaries and in addition may receive 
  1.13  per diem payments and reimbursement for necessary expenses in 
  1.14  performing the duties of the office as set by resolution of the 
  1.15  county board.  The salary and schedule of per diem payments 
  1.16  shall not be effective until January 1 of the next year.  The 
  1.17  resolution shall contain a statement of the new salary on an 
  1.18  annual basis.  The board may establish a schedule of per diem 
  1.19  payments for service by individual county commissioners on any 
  1.20  board, committee, or commission of county government including 
  1.21  committees of the board, or for the performance of services by 
  1.22  individual county commissioners when required by law.  In 
  1.23  addition to its publication in the official newspaper of the 
  1.24  county as part of the proceedings of the meeting of the county 
  1.25  board, the resolution setting the salary and schedule of per 
  2.1   diem payments shall be published in one other newspaper of the 
  2.2   county, if there is one located in a different municipality in 
  2.3   the county than the official newspaper.  The salary of a county 
  2.4   commissioner or the schedule of per diem payments shall not 
  2.5   change except in accordance with this subdivision. 
  2.6      (b) The annual salary of a county commissioner in any 
  2.7   county, including Hennepin and Ramsey, may not exceed the salary 
  2.8   of a legislator.  Per diem payments in a year may not exceed 
  2.9   one-third of a commissioner's salary.  The provisions of this 
  2.10  paragraph supersede any inconsistent provision of charter or 
  2.11  other law. 
  2.12     Sec. 2.  [EFFECTIVE DATE.] 
  2.13     This act takes effect January 1, 1996.
