1.1 A bill for an act 1.2 relating to landlords and tenants; regulating certain 1.3 tenant screening practices; amending Minnesota 1.4 Statutes 1994, section 504.30, subdivision 4, and by 1.5 adding a subdivision. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1994, section 504.30, is 1.8 amended by adding a subdivision to read: 1.9 Subd. 1a. [TENANT NOTIFICATION.] A landlord shall notify 1.10 an individual applying to rent a residential unit from the 1.11 landlord if the landlord will use a tenant screening service in 1.12 determining whether to rent to the individual. The notice must 1.13 provide the name and address of the service used. 1.14 Sec. 2. Minnesota Statutes 1994, section 504.30, 1.15 subdivision 4, is amended to read: 1.16 Subd. 4. [COURT FILE INFORMATION.] (a) If a tenant 1.17 screening service includes information from a court file on an 1.18 individual in a tenant report, the outcome of the court 1.19 proceeding must be accurately recorded in the tenant report when 1.20 the outcome becomes available. If the tenant screening service 1.21 reports a pending unlawful detainer action, the fact that the 1.22 action is pending must be included in the tenant screening 1.23 report. Whenever the court supplies information from a court 1.24 file on an individual, in whatever form, the court shall include 1.25 information on the outcome of the court proceeding when it 2.1 becomes available. The court shall maintain and make available 2.2 to persons requesting it, a summary list of completed unlawful 2.3 detainer actions indicating how each was disposed. The summary 2.4 list shall be updated at least monthly. Dispositions of 2.5 proceedings must be added to the tenant screening service's 2.6 report on an individual as soon as practicable after a summary 2.7 listing of dispositions is made available by the court or the 2.8 court has made information on the dispositions available by 2.9 another means, whichever is available sooner. The tenant 2.10 screening service is not liable under section 504.31 if the 2.11 tenant screening service reports complete and accurate 2.12 information as provided by the court. 2.13 (b) A tenant screening serviceshallmay notprovidemake a 2.14 tenantreportsscreening report containing information on an 2.15 unlawful detaineractions in the second and fourth judicial2.16districts, unless the tenant report accurately records the2.17outcome of the proceeding or other disposition of the unlawful2.18detainer action such as settlement, entry of a judgment,2.19default, or dismissal of theaction which antedates the report 2.20 by more than four years.
