  1.1                          A bill for an act
  1.2             relating to motor vehicles; allowing refund of portion 
  1.3             of fee for alternative fuel vehicle permits based on 
  1.4             mileage; appropriating money; amending Minnesota 
  1.5             Statutes 1994, section 296.0261, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 296.0261, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 10.  [REFUND; APPROPRIATION.] A holder of a permit 
  1.11  under this section may apply to the commissioner of public 
  1.12  safety for a refund in the amount of the difference between the 
  1.13  amount paid for the permit and the amount of gasoline tax the 
  1.14  vehicle for which the permit was issued would have paid during 
  1.15  the term of the permit had the vehicle been powered by 
  1.16  gasoline.  A claim for a refund must be filed within 90 days of 
  1.17  the expiration of the permit.  The commissioner of public safety 
  1.18  may require the applicant to submit documentation as the 
  1.19  commissioner deems necessary to verify the claim for the 
  1.20  refund.  In determining the amount of refund to which the 
  1.21  applicant is entitled, the commissioner of public safety may 
  1.22  make a determination of the fuel consumption of the vehicle 
  1.23  using nationally recognized sources of information on fuel 
  1.24  consumption of comparable vehicles powered by gasoline.  If the 
  1.25  commissioner determines that the vehicle is of a type that is 
  1.26  most commonly powered by special fuel rather than gasoline, the 
  2.1   commissioner shall make the determination using consumption of 
  2.2   special fuel rather than gasoline.  The commissioner of public 
  2.3   safety shall pay to the applicant the amount of the approved 
  2.4   claim.  The amounts necessary to pay claims under this 
  2.5   subdivision are appropriated to the commissioner of public 
  2.6   safety from the highway user tax distribution fund. 
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      Section 1 is effective July 1, 1995.
