1.1 A bill for an act 1.2 relating to health; modifying the definition of 1.3 practice of pharmacy; amending Minnesota Statutes 1.4 1998, section 151.01, subdivision 27. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1998, section 151.01, 1.7 subdivision 27, is amended to read: 1.8 Subd. 27. [PRACTICE OF PHARMACY.] "Practice of pharmacy" 1.9 means: 1.10 (1)theinterpretation and evaluation ofprescriptions1.11orprescription drug orders; 1.12 (2)thecompounding, labeling, and dispensing, or labeling1.13ofdrugs and devices (except labeling by a manufacturer or 1.14 packager of nonprescription drugs or commercially packaged 1.15 legend drugs and devices); 1.16 (3)theparticipation in clinical interpretations and 1.17 monitoring of drug therapy for assurance of safe and effective 1.18 use of drugs; 1.19 (4) participation in drug and therapeutic device 1.20 selectionand; drug administration for first dosage and medical 1.21 emergencies; drugutilizationregimen reviews; and drug or 1.22 drug-related research; 1.23 (5) participation in the practice of managing drug therapy 1.24 and modifying drug therapy, according to section 151.21, 1.25 subdivision 1, on a case-by-case basis according to a written 2.1 protocol between the specific pharmacist and the individual 2.2 dentist, optometrist, physician, podiatrist, or veterinarian who 2.3 is responsible for the patient's care and authorized to 2.4 independently prescribe drugs. Any significant changes in drug 2.5 therapy must be reported by the pharmacist to the patient's 2.6 medical record; 2.7 (6) participation in the storage of drugs and the 2.8 maintenance of recordstherefor; 2.9(6) the(7) responsibility foradvisingparticipation in 2.10 patient counseling on therapeutic values, content, hazards, and 2.11 uses of drugs and devices; and 2.12(7) the(8) offering or performingofthose acts, services, 2.13 operations, or transactions necessary in the conduct, operation, 2.14 management, and control of a pharmacy.
