  1.1                          A bill for an act 
  1.2             relating to human services; mandating certain actions 
  1.3             relating to competitive bidding and delivery of 
  1.4             services; requiring disclosure of certain information; 
  1.5             establishing an advisory committee. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [FUNDING SYSTEM.] 
  1.8      Within one year of the effective date of sections 1 to 3, 
  1.9   the department of human services shall propose a funding system 
  1.10  for day training and residential services for persons with 
  1.11  developmental disabilities and serious mental illness that: 
  1.12     (1) requires dollars to follow consumers according to 
  1.13  individual consumer need and to be spent according to individual 
  1.14  consumer choice; 
  1.15     (2) assures that the needs of all consumers, including the 
  1.16  most disabled, will be appropriately and consistently met; and 
  1.17     (3) holds the provider of services to persons with mental 
  1.18  disabilities accountable for consumer outcomes. 
  1.19     Sec. 2.  [COMPETITIVE BIDDING PROCESS.] 
  1.20     Within one year of the effective date of sections 1 to 3, 
  1.21  the department of human services shall: 
  1.22     (a) implement a contracting and competitive bidding process 
  1.23  that ensures that private and public services will compete on 
  1.24  equal grounds, by: 
  1.25     (1) ensuring equal application of all funding and rate 
  2.1   setting procedures; and 
  2.2      (2) ensuring equal application of licensure rules; and 
  2.3      (b) disclose all fully allocated costs, including capital 
  2.4   costs, administrative overhead, and other costs associated with 
  2.5   the provision of state services for persons with developmental 
  2.6   disabilities and serious mental illness. 
  2.7      Sec. 3.  [ADVISORY COMMITTEE.] 
  2.8      The commissioner of the department of human services shall 
  2.9   establish an advisory committee to provide advice and counsel on 
  2.10  the development of policies in sections 1 and 2.  The committee 
  2.11  may issue a report to the legislature annually. 
  2.12     The committee shall consist of a representative from the 
  2.13  following interested parties:  service providers, families, 
  2.14  consumers, advocates for persons with disabilities, legislators, 
  2.15  and the ombudsman for mental health and mental retardation.  The 
  2.16  committee shall meet at least quarterly.  Members shall serve a 
  2.17  two-year term with a maximum of three consecutive terms. 
  2.18     Sec. 4.  [EFFECTIVE DATE.] 
  2.19     Sections 1 to 3 are effective the day following final 
  2.20  enactment.
