  1.1                          A bill for an act 
  1.2             relating to education; creating a school enrichment 
  1.3             partnership program; providing for matching funds and 
  1.4             revenue use; appropriating money; proposing coding for 
  1.5             new law in Minnesota Statutes, chapter 124. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [124.312] [SCHOOL ENRICHMENT PARTNERSHIP 
  1.8   PROGRAM.] 
  1.9      Subdivision 1.  [ESTABLISHMENT.] The school enrichment 
  1.10  partnership program is established.  The purpose of the program 
  1.11  is to encourage school districts to expand the involvement of 
  1.12  the private sector in the development of academic programs.  The 
  1.13  program will provide matching state funds for those provided by 
  1.14  the private sector. 
  1.15     Subd. 2.  [REVENUE ELIGIBILITY.] A school district or group 
  1.16  of school districts is eligible to receive state aid under this 
  1.17  program.  Districts may enter into joint agreements to provide 
  1.18  programs or make expenditures under this section.  The 
  1.19  limitations under this subdivision shall apply to these programs 
  1.20  or expenditures as if they were operated by a single district.  
  1.21  A district may receive $1 of state aid for each $2 raised from 
  1.22  the private sector.  The private match must be in the form of 
  1.23  cash and may not be in-kind.  A district must raise at least 
  1.24  $10,000 from private sources before state aid is available.  
  1.25  State aid is limited to the lesser of $75,000 or $10 per pupil 
  2.1   unit per district. 
  2.2      Subd. 3.  [REVENUE MANAGEMENT.] The use of the funds 
  2.3   provided under this section is under the general control of the 
  2.4   school board.  The board may establish a separate foundation to 
  2.5   directly manage the funds.  The funds may be used to acquire 
  2.6   instructional or noninstructional materials of a capital nature 
  2.7   including, but not limited to, textbooks, globes, maps, and 
  2.8   other academic material.  The funds may not be used for salaries 
  2.9   or other employee benefits. 
  2.10     Subd. 4.  [PROCEDURES; REPORT.] The commissioner of 
  2.11  education shall establish application forms, guidelines, and 
  2.12  timelines for the distribution of state aid.  The commissioner 
  2.13  may require reporting necessary to evaluate the program. 
  2.14     Sec. 2.  [APPROPRIATION.] 
  2.15     $10,000,000 is appropriated in fiscal year 1996 from the 
  2.16  general fund to the commissioner of education for the school 
  2.17  enrichment partnership program.  This appropriation does not 
  2.18  cancel and is available until expended.
