1.1 A bill for an act 1.2 relating to elections; eliminating the requirement for 1.3 approval by the county auditor of an election 1.4 conducted by mail; amending Minnesota Statutes 2002, 1.5 section 204B.46. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 204B.46, is 1.8 amended to read: 1.9 204B.46 [MAIL ELECTIONS; QUESTIONS.] 1.10 A county, municipality, or school district submitting 1.11 questions to the voters at a special election mayapply to the1.12county auditor for approval ofconduct an election by mail with 1.13 no polling place other than the office of the auditor or clerk. 1.14 No more than two questions may be submitted at a mail election 1.15 and no offices may be voted on. Notice of the election and the 1.16 special mail procedure must be given at least six weeks prior to 1.17 the election. No earlier than 20 or later than 14 days prior to 1.18 the election, the auditor or clerk shall mail ballots by 1.19 nonforwardable mail to all voters registered in the county, 1.20 municipality, or school district. Eligible voters not 1.21 registered at the time the ballots are mailed may apply for 1.22 ballots pursuant to chapter 203B.
